The
ugly aspects of the
Telltale layoffs story is
getting uglier, as
Polygon reports that laid-off former employees have launched a class action
lawsuit against Telltale for violating the Worker Adjustment and Retraining
Notification (WARN) Act. Word is: "Under the WARN Act, businesses that undertake
plant closings or mass layoffs with fewer than 60 days’ advance notice are
subject to significant financial penalties. Rather than pay fines, a company
must give affected employees back pay and benefits for each day of violation."
GameDaily.biz notes Telltale may be able to contest this suit since the law
allows for "business circumstances that were not reasonably foreseeable." They
also say that it may be possible to successfully sue under California's own version of the
law, which does not offer similar allowances for unforeseen circumstances.
