MCV reports that German publisher CDV has won a legal victory over Gamecock in CDV's claim that GameCock failed to supply four games in time for their planned Christmas 2008 release. CDV claimed advances of $7 million were paid for seven games to be released of the holidays, but that they gave notice to terminate the deal in November 2008 over failure to deliver four of these titles. Gamecock rejected this claim, eventually delivering the games and saying they were not late. The report indicates the court found in CDV's favor regarding three of the four games, and this empowers CDV to seek an injunction preventing Southpeak (GameCock owner) from selling the games in question, which are not specified.
