As someone else said, the arguement was that it was placed in a shared folder. IE, the instant he ripped a CD, made an mp3, and placed it on a shared folder.
I'm against pirating and think it's well within the RIAA's rights to try stopping it so long as they do it correctly. Presently the way they are handling the whole issue is idiotic. Their tactics are horrid, their evidence is poor, and if they 'think' you're working against it then you're screwed.
I mean, really... a screenshot showing an IP address? Puh-leeze. Here, let me show you a PNG showing that it was an RIAA president sharing it.
That and the amount they seek for compensation is asinine.
So fine, try to stop pirating: I applaud it. But do it intelligently and stay within the sandbox.
