Take-Two Sues Jack Thompson

Jack Thompson suing someone would just be another "legal brief" post here, but Take Two Sues Jack Thompson over Manhunt 2, GTA4 is news of that classic "man bites dog" variety. To catch you up, we'll just quote Game Politics' summary of the case:
The suit alleges that Thompson’s public nuisance tactic violates Take Two’s First Amendment rights. Lawyers for the game publisher argue that the Florida statute under which Thompson is seeking to have the games declared as nuisances essentially makes the controversial lawyer “a private attorney general on behalf of the State of Florida.”

Take Two is also seeking to recover from Thompson its attorney fees and other costs incurred related to the pending legal action.

For his part, Thompson criticizes the Take Two complaint in a writ filed with the Florida Supreme Court, and rather dubiously takes credit for a recent shareholder revolt which is expected to result in the firing of CEO Paul Eibeler as early as next week.

Since when is it against the law to trash another company publicly. If I wanted to stand out in front of Bank of America & protest the fact that they encourage Illegal immigration by giving out credit cards to people who break the laws of this country, I should have every right. As long as I'm not disturbing the peace I can be there all day with my signs & such.

Libel and slander are both a part of the First Ammendment.

Also, Thompson has repeatedly tried to suppress the release of games published by Take Two (Rockstar's), and every attempt he's made has failed with the law citing the First Ammendment. If it's impacting their business, they may have a case.

JT is trying to use the "public nuisance" laws to get the games banned. Take Two is arguing that using the "public nuisance" laws in such a manner is a violation of their First Amendment rights.

They are very likely to win.

No, you are confusing him exercising HIS first amendment rights with him violating THEIRS.

What they are claiming is that his constant lawsuits are violating their right to free speech. He is trying to use public nuisance laws and the court system to censor them.

Why can't gamers do the same thing to him? This guy is annoying as hell. I almost think he's an evil form of viral marketing. Public nuisance just barely begins to describe his actions.

I blame the bastard for the lack of gore in Company of Heroes. At least in SupCom they can't censor awesome machine explosions. But sure, that guy that just got hit by a 105mm howitzer round? Yeah, he has no more blood.

The deficiency of proper gore in gaming began long before Thompson came onto the scene. Remember the Soldier of Fortune games? Not a single game since has even come close to the same level of explicit mutilation. Remember how when you shot people in Hitman, there would actually be bullet holes? Those mysteriously disappeared in all the sequels. Imagine how much more brutal and disturbing Condemned would have been had it featured realistic, location-based mutilation and gore. I can only hope that the potential sequel will sate my bloodlust.

So why have games been neutered as of late? Multiple potential reasons:

1) With the advent of normal/parallax mapping, specular lighting, etc, it might be harder to create realistic-looking mutilation due to the fact that models don't have all the polygons they appear to have.

2) With countries like Germany and Australia banning/blacklisting games left and right, publishers would rather not invest time and money into features that they'd inevitably have to remove for acceptance in these territories.

Either way, the lack of gore needs to stop. With exploitation flicks like Hostel going mainstream, there should be no reason for games not to follow suit.

Ah... hahaha! Good one. Yes, look at all that innovation. I mean, we have C&C3, GR 5, R6 5, NFS 11, Madden 500, NBA whatever 600, Doom 3, Unreal Tournament 3, etc, etc...

Seriously though, some games need realistic gore in order to reinforce their immersion. As I mentioned, Condemned would have been much more visceral had it had realistic violence. Similarly, Manhunt would have been far more satisfying if it had more realistic gore. Same goes for Hitman.

Oh my. I can only imagine how delightful those games would have been with proper gore. Imagine it: A huge ball of bloody, twisted flesh and random sharp objects, rolling through a city while tiny little pedestrians scream in horror at their impending doom. If you look at the ball closely enough, you can still see the tiny limbs of survivors, flailing and twitching in agony. Though technically, nothing in those games get squished. They just become part of the ball. What a pity.
