Jack Thompson gets the boot on Ars Technica (thanks Mike Martinez) has word that the attorney's attempts to voluntarily remove himself from his current anti-gaming crusade (story) have been rejected by the judge on the case, at which point the judge booted him from the case and rescinded his temporary license to practice law in Alabama, saying "Mr. Thompson's actions before this Court suggest that he is unable to conduct himself in a manner befitting practice in this state." In an ironic twist that would make Alanis Morrisette roll over in her hot tub, Mr. Thompson ends up defending the constitution as he defends himself: "Did this Court somehow, in the last three weeks, manage to repeal the First, Fifth, and Fourteenth Amendments to the United States Constitution?"

And while I'm not a HUGE 2 Live Crew fan they had some decent singles. Okay, just that one decent single. You just had to have heard it when it was released, and NOT in light of music today - music blazed by this band and others.

(hey, that was the name of a 2 Live Crew track. Quite the coincidence.) but despite them having 100s of thousands of fans, maybe millions, the establishment won that one.

How so? You can saw WTFUW on any CD. Just have to put a label on it. They didn't STOP them from doing what they wanted to do or say what they wanted to say. It wasn't really a win for anyone. It was more of a stalemate.

The issue was that of obscenity, which the SC basically laughed at the allegations. It was a local issue. On top of that, it just helped them sell more copies of the album. Score a big one for free speech. Although Jack Thompson won the first round, he lost all rounds following. You can now purchase at any record store across the nation. - not that it is worth the money though....

Wait 15 years or so and suddenly there's a really easy way to rally a defense against assholes like this. Penny Arcade alone has probably counted for most of this.

So how can this Internet movement have anything to do with a Judge's decision? No man is an island. Jurors aren't supposed to pollute themselves with outside influences. But when a Judge goes home and clicks on his MSN homepage what is he going to see?

The problem we face now is that you're absolutely, positively guaranteed that whoever takes his place on the case will be less loco (how could they not be?), and therefore more likely to pose an actual threat to the defense.

This was first reported on gamepolitics.com like a week ago. It seems it took a while for a lot of the other news sites to pick it up which is funny seeing as how much hatred this idiot has brought on himself. You should see how Thompson has bene spinning this too. He's actually gone so far as to accuse a JUDGE of ethical violations. You should see the controversy that's developed over his new book at Amazon.com too. He's threatened Jeff Bezos with a lawsuit because Amazon won't remove all the negative reviews that people are posting.

So he's saying he's either in double jeopardy or he's being deprived of LL+POH ?

Fourteenth amendment

No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

Section 4. The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.


I haven't a clue which part of this he thinks applies here.

At least the legal profession is taking note of him - with any luck he'll be permanently disbarred or something.
