Rockstar & Take Two Sued

Gamemaker Sued Over Hidden Sex in GTA (thanks Mike Martinez) reports a New York woman has filed suit against Take-Two Interactive over the adult content that turns out to be hidden within the game that she bought for her 14-year-old grandson (in spite of the game's 17+ rating). Here's the latest on better living though litigation:
Florence Cohen, 85, of New York, said in the lawsuit filed in U.S. District Court in Manhattan that the game's manufacturer, Rockstar Games, and its parent company, New York-based Take Two Interactive Software Inc., engaged in false, misleading and deceptive practices.

She sought unspecified damages on behalf of herself and all consumers nationwide, saying the company should give up its profits from the game for what amounted to false advertising, consumer deception and unfair business practices.

Many of you dont seem bothered that kids have gotten thier hands on this mod (Yes they're smart enough to install it) Im disturbed by the reactions across the internet in support of having this type of hidden content on games. It's all so amusing to many of you when it isn't amusing at all.

Freedom of speech is what gives mature individuals like myself the right to enjoy artistic, entertaining products like GTA. If this right-wing, conservative Christian coalition that has fused itself with our Republican party has it's way - in order to make up for the indifference of parents who let their kids do what they want, see what they want, and play what they want - adults like myself will be forcefully denied certain enjoyably qualities of life.

I shouldn't have to suffer because these parents are too "scared" to be strict with their children and actually implement some kind of control over their activities.

The ESRB says it does, and that is what counts. The ESRB handed consumers and their lawyers the evidence they needed.

Actually, a better example would be:

You take your child to a play/musical which is "Rated R" (though at least in the US I don't believe theey actually rate real-life stuff).

Anyway, your kid gets bored and in the middle of a scene sneaks behind the stage and sees the leading man and woman getting in on in-character (but only partially in costume). Maybe it's the acting troupe's tradition, maybe not.

In any case, you saw something you weren't supposed to see.

The game was initially given a rating which misrepresented the content.

The game does not contain "strong sexual content" as some R-rated films do. The fact that our legal system allows for this speaks volumes of what may be in store for the future. However, when anarchy again reigns, I will almost pity the lawyers. I said "almost"...

I think it'd be pretty important to prove intentional deception.
The game was initially given a rating which misrepresented the content. Rockstar created that content. Case closed in terms of liability. The ESRB is also liable though, and I am surprised they are not also a defendant in the lawsuit.

This suit will have "legs" and will likely result in a settlement by Rockstar.

I know for a fact that that is not true in the UK (it might be in the US).
In the U.S., an "R" rated movie means "no one under 17 admitted without an adult."

If it's an 18+...
As well stated in a post below, an "M" rated game is intended for those 17 and older.

As for the "She sought unspecified damages on behalf of herself and all consumers nationwide" part, I think that means it's a class action lawsuit, right? Ie, anyone can join in? Like the smoking lawsuits awhile back?

Ofcourse, I don't think it stands a chance in court. Wouldn't her lawyer have to prove actual harm being done to the kid based on the misrating of the game? And won't Take 2's lawyer simply say "Well, seeing as how you gave this game to a kid that was younger than our recommended age anyways, weren't you already aware of the harm that was going to be done on his fragile psyche?"

It seems pretty clearcut to me, but the USA never ceases to amaze me in its absurd rulings.

Btw, I love how everyone still keeps bitching about "right wing freaks", even when it's a fucking DEMOCRAT who's leading the way in this instance. Try to get off your idiot political horse for a second, and realise both sides are pandering for votes here, and don't really give a shit.
