The idea is that they are going out anyhow, so they might as well bring others with them, or perhaps in the scramble they will reclaim some small fraction of dignity/money.

...but reading the original article and it's follow-up about the Phantom being aptly named for its failure at having a physical presence, Infinium Labs and its non-existent prior products, and CEO Timothy Roberts and his 'illustrious' past, everything seemed quite methodically researched and the path of logic clearly outlined throughout the article. I saw no slanderous or libelous remarks or outrageous claims (at least from HardOCP's side).

While driving the costs up to implode a rival with litigation is something Microsoft has perfected over the years, small shady companies seem to be following suit since Microsoft has been allowed to keep on pursuing that tactic with impunity. Also, you may be interested in the differences in Florida law pertaining to slander/libel/defamation of character cases. I’d be willing to bet, aside from being a friendlier court with home field advantage, there are looser requirements for proving damages. Since Infinium Labs is apparently a Florida based company you would have to assume a judge or jury would not exactly be partial to losing any perceived business.

Aside from emptying HardOCP’s pocketbook, it’s just a media gambit that is obviously poorly thought out, much like Mr. Roberts previous businesses. It’s like a mini version of the SCO saga. For those who don’t follow SCO’s assault on GNU/Linux, they originally made huge outrageous claims and have taken just about everyone to court, including a slander suit against Novell, which Novell recently filed to have dismissed for lack of any foundation. Now the Open Source community is against them, all the claims they made have been shot down with proof (the ones SCO made public, at least), the media is having a field day with evidence of Microsoft backing the SCO lawsuits via a third party, and Germany has slapped one onerous ruling against SCO that seems to be harbinger of worse things to come. SCO, a once thriving company, is waiting to die.

Infinium Labs, much like the CEO’s previous ventures, never had a chance to live.

The Penny Arcade people were sitting around one day, bored, and thought about what they could do to entertain us. So, they made up OCP and this thing called Infinium labs. In turn, they made the two fight each other.

Really, lawsuit? Has anyone seen any case numbers, jurisdictions or case file claims? It's all overhead talk, and the only way people come across this are people that are afiliated with PA.

You're forgetting, High Ping, that we'll have roughly one week to escape the supernova (that is the speed of light delay between here and the sun).

So if they lose the case, the most l337 scientists in the world would arrange a way to evacuate the solar system in a week.

If Infinium Labs somehow wins this case, the sun will explode and kill everything in the solar system.

There will be free speech lawyers lining up to get this case. I dont think hardocp is gonna have probs. Infinium is trying to intimidate free speech with lawsuits, this can't be allowed to stand.

Err... free speech doesn't enter into a case of Libel / Defamation of character / Slander.

I'm not saying that [H]ardOCP did any of those things, but "free speech" is not a defense against those charges, in a court of law.

It's a simple case of "Who is telling the truth".

If [H]ard can prove that their allogations were accurate.... IL loses, period.

If IL can prove that [H]ard's allogations are false, THEN IL HAS to prove that [H]ardOCP knowingly and willfully posted false allogations, in order to win the case. That said... it's much tougher for IL to win a case of Libel, because they have more to prove, than just the "statements being inaccurate".

I'm not trying to be an "armchair Internet lawyer"... the only reason that I have any knowledge of this is because my family was involved in a Libel / Slander case.
