Yes there is. You can't steal intellectual properly. Theft is when you take something away from someone. If you copy code, it is not theft.
That would depend on if you use the word "steal" as a legal term, or as it is commonly used.
As it is commonly used, it is possible to "steal" a chef's prized recipe (though he still may know it), or "steal" an idea from an inventor (though he may still have it). Steal just means to take against the wishes of the owner. You can still steal something intangible, and the owner may still posess a copy after the crime.
Regardless, whether it is legally "theft" or not, it is still illegal.
