Sorry guys, but the legality of modding an Xbox is arguable. It's probably circumvention of copy protection whether or not you use it that way (and using it to play even "legal" backups is using it that way!), which if I recall correctly is a federal crime under the Digital Millenium Copyright Act. IANAL, obviously.

EULAs are also not being upheld in court. I can't remember if it was the third or the ninth district court, but they basically said "We realise that a license agreement is very desirable and profitable for a publisher, but that doesn't make it legally binding."

In this case, yes, you can Mod the hell out of your Xbox, as long as you don't do anything illegal with it. Actually modding your Xbox, and then finding someone to get on Live would be illegal, and MS could sue you. But for just modding your Xbox, they haven't got a leg to stand on and they know it. As much as they want their fucking EULA to rob people of house, wealth and soul, there is still a thing called owner privilege. When you buy an Xbox, you OWN the damn thing, and nothing Microsoft says or does will change the fact that it is your Xbox, to do with as you please.
As long as it doesn't affect anything else that Microsoft owns.

While we're on the subject, if someone mods their Xbox, MS finds out about it, and then sues them, the strongest leg MS'll have to stand on is if MS claims that the user violated the EULA, and the lawsuit is for a contract violation, not quite as an "illegal" thing as stealing or shooting someone. Contract violation is illegal to keep people from breaking promises. I think EULAs are shitty things to do to people (mostly because I don't think I should have to sign a contract for every little fucking piece of software I install).

Yeah, no Linux demand, AND this vulnerability is no worse than anything that's out there already. Relying on a vulnerability in the dashboard is pointless, cause MS is already fixing it now. Not that it really matters anyway, since you still have to do the 007 trick to hack it.

If someone came upwith a way to burn a CD that allows people to boot an unmodded xbox and run arbitrary code, THEN MS has problems. Someone could put Linux on a CD, a boot loader for pirated games, etc. But until that time all these xbox hacks are more hype than substance.
