release and a related News.com article called Novell
challenges SCO's Linux claims that add significant complications to the
recent high-profile case in which SCO sued IBM for more than $1 billion,
alleging that misappropriated Unix technology has been built into Linux (story).
Here's a bit on the legal tangle:
In a letter to SCO released Wednesday, Novell asserted that it retains Unix patents and copyrights, demanded that SCO reveal where Unix source code has been copied into Linux, and raised its own threat of legal action to compensate for damage that it says has been done to customers, programmers and companies using Linux.
"To Novell's knowledge, the 1995 agreement governing SCO's purchase of Unix from Novell does not convey to SCO the associated copyrights," Novell Chief Executive Jack Messman said in the letter to SCO Chief Executive Darl McBride. He said that SCO evidently realizes this, because "over the last few months you have repeatedly asked Novell to transfer the copyrights to SCO, requests that Novell has rejected."
But SCO Group said that that issue is beside the point, because the company bought full rights to the Unix intellectual property, including its copyrights, patents and the right to enforce those patents, according to Chris Sontag, head of the SCOsource effort to derive more money from the Unix intellectual property.

So, is anything similar going to happen in the Futuremark situation? Is someone going to come out an say that it's all moot due to some lame goings-on at Futuremark?

I don't see how you can say that with any certainty... one of the reasons so many servers run Linux is because it is free.
Also, why post a link to Slashdot? All they did was post a link to a story that was already published.
Because I feel it's important to show the sources of information... I'd rather include an extra link with each story rather than cultivate the impression I came up with this story independently.
Anyway, it's interesting to read so many criticisms of the choice of linking to this story, since I often worry I can be too discriminating about what to post.

Um...NO. It does have an effect if SCO wins because they could potentially hold the keys to linux. And they could charge whatever they want for it. You think all those game servers are going to stay up when the OS running them suddenly has a fee attached to it?
I don't think SCO has a snowballs chance, but their plan of suing everyone into compliance (taking a chapter from the book of Rambus) is alarming, to say the least.

I agree: this article doesn't have anything to do with gaming. A few companies are fighting over rights to some Unix/Linux code. At some point they will settle or drop the case.

Eh, it has the opportunity to improve, it just isn't, which is mildly disappointing.
Agreed. And this does effect gaming if you run linux servers for games. If you don't like it, don't read it.

Uhh... I'm not a linux guru or anything but isn't hosting a game server on linux a little different from actually playing a game on linux.

A good chunk of the web is hosted on linux, as are tons of game servers, so yeah, i'd say this has to do with games.

Right now, it's not a worthwhile gaming platform, and has (imo) limited use as a desktop environment.
I'd love to see it improve, but I'll admit, I'm a geek and enjoy messing around with Linux/UNIX. Oh well.
