Out of the Blue

Out first winter in this house was two years ago, and the snow was pretty extreme, about half-way through the season I began to regret not having sprung for a snow-blower. Last year we had hardly any snow at all, making me feel smart for having not succumbed to that snow-blower temptation late in the previous winter. On the other hand, this year has been one of the most extreme I can ever recall, and here we are in the first week of March, and sure enough it is snowing heavily once again. Since this is the month that comes in like a lion and goes out like a lamb, it certainly seems too late in the season to go for the automated snow remover, and if the pattern from last time follows, one won't be needed for next year either, but I may just try and be smart about this (for a change) and try to pick one up during the off season after spring has sprung. Of course, as luck would have it, if I pick up a snow blower, we'll probably go ten straight years without a flake, but at this point, that's a risk I'm willing to take. Yeesh.

Hey Blue, any chance you could post a picture from out your window? I lived in North Jersey (Sussex, Passaic and Bergen Counties) all my life until recently, and now I'm stuck in FL. Yuck! It's hot, humid, sticky and just disgusting down here. Maybe something to remind me of home?...Yeah, and I can even turn the AC down some more to make it feel like those drafty winter days...

*sigh*

I know I'll come off as one of those heavy snow area snobs, but cmon, the NJ/NYC area gets like what, 18 in. of snow on average for the whole winter? I'm surprised you guys need a snow brush for your car much less a snowblower.
I suppose every 10-20 years you get a "heavy" snowfall, but unless you get 100+ inches of snow a year, I think you can get by with getting a little exercise. (the two or three days for the winter that you get enough snow to worry about)

The mall and city should have saved themselves time and attorney fees and handed him a check on the spot. That guy is gonna make millions and he won't even have to hire a lawyer.

Well, look at this way, Blue. If you do invest in the snowblower and nary a flake falls, consider that you've now invested in not having to deal with the snow for a long time.

Yeah, Blue, you're right. If you buy a snowblower now, you will never need it. However, a few hundred dollars for that kind of insurance is cheap!

The mall is private property, so they have the right to ask anyone to leave, even for a reason like not liking their T-shirt. If he does not leave, he is trespassing, which is what he was arrested for.

However, when something like this gets media attention, the company behind the lawsuit frequently backs down to avoid bad publicity. We'll just have to see.

All in all though, this leaves a bad taste in my mouth. Is the war sentiment that strong now...? I fear for the future.

The mall is a public accomodation. If you build a structure intended for public use then you are bound by certain well-established laws. You can't build a mall and ban, say, black people or jews from shopping there. You can do so in your own home, but not a mall, or office, or factory. That's the law, like it or not.

That being said, I suspect there's more to this story than is being reported.

According to the local news station (I live in Guilderland), they've already backed down. Verify it at http://www.wten.com/Global/story.asp?S=1165243&nav=6uyMEOKJ

And crap, it's snowing again.

Heh, I'm glad to see that there are a few fellow skeptics left out there that won't take everything they read at face value.

Personally, I'd like to see a picture of the shirt in question.

There are next to no real details here but...

I worked in several malls for the same company when I was in the retail racket.

It would not suprise me to find out that the security guards involved in this are over zealous wanna-be cops.

I could easily see some of the security guards where I worked getting into a 'patriotic' based argument with a shopper or other mall employee.
Sad but true.

The company I worked for was sued for millions of dollars (and settled out of court) because of sub-contracted security guards taking company shrink policy into their own hands.

These guys can get a little nutty.

"Downs is the director of the Albany Office of the state Commission on Judicial Conduct, which investigates complaints of misconduct against judges and can admonish, censure or remove judges found to have engaged in misconduct."
So this guy can get Judges fired?
If he was harassing other customers I would understand the guards asking him to leave, but asking someone to take off their shirt in order to stop harassment seems a bit crazy
A guy here in Utah was forced to leave a Mall because he was wearing a dress. I'm not sure if he has won that lawsuit.
Oh and I agree with Rigs. We need some pictures of all the snow
