After thinking about it, I do not think that Blue's should host demos/files if they know that they are restricted or part of some exclusivity deal. I can try to make some rationalizations (I already subscribe to CGW, I just want to play the demo to test out the game, I already have a pre-order placed with EBg, the other sites are listing it, etc.), but that is all they are-rationalizations.
Ultimately, it comes down to who owns the item in question and what they (legally) want to do with it. If they want to make a demo and release it to only one person, that is their choice to make and their legal right. I would like to think that demos will be released to everybody, but that doesn't change anything. This is in addition to the monetary and technical issues.
Although still a gray area, I think that Blue's should report on demos/files, but not host them unless they have been allowed to and/or there is no other notice preventing them from doing so. Likewise, a demo/file should be taken down at the owner's request. There is still the gray area (Oh, you don't mirror a leaked demo, you just point out exactly where it is?), but at least the argument can be made that Blue's is only reporting news.
That's not necessarily what I want, but that is what I believe is fair and legal. Disagree with things all you want, but it is still *their* property. Perhaps the are making a mistake, but nobody is perfect. As you can tell from my earlier post, I did download the leaked demo following the rationalizations that I listed at the very beginning. That was wrong on my part and I will actually uninstall/delete the demo, eagerly awaiting my new issue of CGW.
We may not like things, but that doesn't let us just change things as we see fit (unfortunately :o). Just imagine if some of these same arguments were turned around or used on other things...
