My job in New York had a Non-compete clause. It only ever mattered if somebody bother to report it though. But that was back then.

Mine right now has a 2 month period.
I gave notice 2 weeks ago, and they're holding me to it, but also don't want me having fresh information since I'm going to a competitor, so they're paying me to sit at home for 6 weeks.

I'm a rare situation where this actually rocks.

If I was paid for it sure. The clause mentioned nothing about being paid. If I recall right… again this was over 20 years ago now. That if you found a similar job outside of the company without upper management approval you would be terminated immediately. If there were lawsuits involved,I’m not sure.

To it they never specified what constitutes a competitive job. So I guess they just held the sword of damacles(sp) over your head for anything the company dislikes.

I've been under NCAs most of my adult working life (present job excluded). I've always ignored them with no repercussions. Sorry, I'm not a slave to whom you can dictate.

When I think of NCA, I always think of Tom Leykis, who was not allowed to seek employment as a radio host after ABC fired him for like five years or something.

Alowing employees to seek employment after being laid off will only lower profit margins and raise wages. This is very unfair to business who depend on "labor shortages" to justify their exorbitated rates and low pay.

Workers should not be allowed to switch jobs unless their owners allow them to,
The thought that someone could change jobs for better working conditions or higher pay is the antithesis of what makes America great.
