I actually know someone who was asked to voluntarily resign. He said "no.", they stopped sending him work. So, he sat at his desk eight hours a day surfing the web or whatever. It took almost two years for them to get around to laying him off. And he got a reasonable package when it happened.

Here in the USA we try to be business friendly by having low taxes and a minimal safety net which just means businesses have to provide the safety net anyway.

It does do a good job of making it difficult to start a small business though - if we had universal health care that would be a lot easier.

While Japanese business law can be complex, most of it boils down to that they have a far wider safety net due to the ingrained sense of 'duty' in their society, so asking for voluntary resignations is more common than laying off. Remember, this is a country that prides itself on service to others, for good or bad.

Also, resignations doesn't immediately mean that severance wouldn't be paid, but that is more about what position the company is in.
