Meanwhile, the Battle for MIddle Earth games are still lost in licensing hell, and seemingly will never released on GoG(where I would happily rebuy them to get rid of having to use CD cracks or other such mummery to play the games)

It's theirs to make money off of for as long as they exist. It's not like they are gambling all their money on something that needs to pay off in 2 years or else.
