Activision Sues COD Cheat Company

The Verge reports that Activision Publishing is suing Engineowning UG in California District Court, alleging the German company illegally sells cheat software for the Call of Duty series (thanks Kxmode). Due to the secretive nature of such businesses, part of the brief outlines why Activision believes several named individuals are involved in the business. The suit also names (or, technically, doesn't name) 50 anonymous "Does" as defendants. Activision accuses the company of harming fair play in a wide range of games over an extended period:
Via the EO Website and other related websites and social media accounts, EO and numerous affiliated individuals and resellers sell cheats for numerous COD Games, including without limitation Call of Duty: Warzone, Call of Duty: Modern Warfare (2019), Call of Duty World War II, Call of Duty: Modern Warfare III; Call of Duty Black Ops, Call of Duty Black Ops II, and Call of Duty Black Ops III (collectively, the “Cheating Software”). EO also claims to be developing new cheating software for the popular multiplayer game Overwatch, which is owned and published by Activision’s affiliate, Blizzard Entertainment, Inc. The Cheating Software enables players to manipulate the COD Games to their personal advantage, such as by automatically aiming weapons, revealing the locations of opponents, and allowing the player to see information that is not normally available to players because it would give them an unfair advantage within the game.

They don't need a specific law banning cheating in games, they can simply point to a breach of contract. When you make an account for (almost) any online multiplayer game, you have to accept the Terms of Service (along with the EULA for installing the game in the first place). The ToS is considered a legal contract and every ToS I've seen for an online game has strictly prohibited any form of cheating.

Yeah I don't know what people including Craptivision were thinking. Releasing a v1.0 "anticheat" first in the Asian market made it quite easy for those folks to develop workarounds just in time for Ricochet's release in North America and elsewhere.
No matter what part of the Galaxy they released it in first, whomever lived there would have developed workarounds.

Well if you really wanted to prosecute them, making your lawsuit actually happen in the EU where Germany is a part of would be good start no? Tis be illegal here too, but lawsuit in the USA doesn't affect a German UG at all but a local lawsuit would, since only a local judge could find them in violation of the (GMBH related) laws. Which are a German thing the US doesn't have. So even if damages were found, the UG would only be responsible for however much money it has, and NOT the people behind it.

So this is a super dumb move by Activision

but have yet to sue the guys behind Cronus Zen its a funny PC game that made this article and the guy was pretty pissed of I mentioned Console users can use this pay a one-time fee and never have to worry about getting banned ever. But was still pissed the PC uses only paid 10 bucks for there but failed to mention that 10bucks a month plus a chance to get banned. I part of the reason PC gamer Reviews are so biased if you counter their agenda they get pissy. and at this point I am not sure why I have not paid for it myself because playing against a console user with there aim assist on top of it. It is almost a requirement at this point they sold soo many of them.

I don't think it's possible to stop the cheating, technically. I also believe it has sadly, forever ruined online gaming. And it's not just FPS's that suffer from this, but that's probably the worst hit genre.

I stopped buying FPS's that don't have an incredible single player component, years ago. You can't play a FPS online without running in to cheaters. If you watch pro-gamers playing on Twitch, they run in to them all the time. It's not a "paranoia" thing, which for some people, they do like to call people who are good at the game as cheaters. Rather, it's just clear cheating with aimbots, wall hacks, etc. You can watch the "killcam" replays and see people shooting people across the map who are not visible. Snapping to their exact direction, firing and then repeating. Shooting through walls at targets not visible.

FPS was always my favorite genre. Long gone are the days in the 90's when you could join a server and expect there to not be people cheating. Some did, but it wasn't as easy as it is today where every idiot with an inferiority complex pays for a subscription and activates it with a couple clicks of the mouse.

I don't have any issues with cheats for a singleplayer game, but my patience for cheating runs out once it starts impacting other players in the game you're playing.

ActiBlizz is not the first major company going after cheat developers for multiplayer games, and from my recollection previous efforts have worked out reasonably well for the companies. I expect some sort of monetary award in the range of whatever the cheat devs earned from sales of their cheats (and possibly from ads on their site) and some sort of punitive award along with an injunction against making further cheats. There almost certainly won't be any jail time involved unless some of the cheat devs have (suspended) convictions for something else or are already under an injunction against making cheats.
