Out of the Blue

A few of you have commented on a recent change in the links roundup below, but I thought I would address it directly. For years we've posted VideoSift video links, in particular because our buddy Ant is part of that community, and made submissions from there. Over time there have been many requests to post the original YouTube versions of these links. I resisted these, because I felt VideoSift earned the traffic this sent them for finding the videos in question. But recently some technical difficulties caused me to finally decide to post these as YouTube links with a credit to the source. I trust this will make things easier for some, and also makes it easier to participate in a video's main forum discussion. On a side note, for some reason we don't get a lot of video submissions, so if you see one worth sharing, feel free to pass it along.

At least imo, he couldn't use puffery because his speech is the same, even when he pretends to be knowledgeably serious.

puffery wouldn't work here. because he's not the one being charged with a crime, the 5th amendment doesn't apply. they're only seeking his testimony in a separate case so there's nothing to defend. he has to tell the truth or they can throw him in jail for contempt of court. i think he'll likely go with the 'i don't recall' bullshit. legal remedies for saying it, even lying, are sparse.

RIght. It should. However, he might be able to use this "Puffery" excuse I mentioned. I've read of instances where corporations have used that argument where common sense would respond with a loud "bullshit". But the legal system sometimes accepts this excuse, so you never know what might happen.

Oh, I understand what you are saying. I'm just not sure the legal system will work in such a common sense way, it seems like it often doesn't. There are solid well known reasons rich people rarely get convicted of anything...

He could claim puffery but I seriously doubt any court would ever accept it given the resulting actions.

There's an old legal remedy to that. It's a very simple phrase that let's you off the hook without perjuring yourself..."I don't recall" - e.g. 'I don't recall if that ever happened, your honor.'
