Kind of, but the allegation is that McAfee lied about not being involved with any trading of his own. AFAIK it's not illegal to go on Twitter and talk crypto to millions of followers, but the fraud comes in when you are intentionally misleading people for your own gain.
So it'd be like if Elon was on there scaring people into selling Bitcoin so the price would go down before he dropped $1.5B on it, or if he hadn't disclosed the purchase and then dumped it for a profit after hyping the price up some. I'm not following it that closely, but I know they're asking questions about exactly when he bought in and why... If he just really thinks it's a good thing and put his money where his mouth is, there shouldn't be an issue.
Most of the whales making big money are just quietly manipulating things behind the scenes like they do with the stock market. Much harder to catch them that way, or prove any blame even if you do.
