Valve Loses Controller Patent Lawsuit

Law.com has the results of the patent infringement lawsuit over the Steam Controller mentioned last week (thanks VGC). Word is the jury ruled in favor of the plaintiff, and Valve is on the hook to pay them $4 million:
The number is on the low end of the damages range sought by Ironburg Inventions, but jurors also found Valve Corp.'s infringement was willful, raising the possibility of enhancements. Valve had argued there was no infringement.

The intellectual property holding company for video came controller maker SCUF Gaming has won a $4 million verdict in the nation’s first all-virtual patent infringement jury trial.

I had one of these as a kid... and I'm above the mean age for readers of this page. Thing broke a few times and had to take it apart to fix it... 100% mechanical switches inside, good stuff!

Epyx 500XJ

Can't say for sure that is prior art... but seems to have them beat by at least a dozen years...

That having been said, their controllers do look sweet. My bad fingers are my middle fingers or I would consider one for accessibility reasons!

No. It's obvious because it's obvious.

Except for judges and juries who sometimes can't see the obvious staring them in the face because they don't live in that world. It's called a person "having ordinary skill in the art".

The fact that patent decisions can be made by laymen nooblets with zero clue about patents is the greatness of this decision and court setting. And why I call it a hallmark decision for patent trolls. Every, single, patent troll is gonna want this kind of court proceeding now in that federal state. Counter-claims are nearly impossible to make via zoom as you can't engage with the jury nor does the attacking patent troll have to show any actual products.. if you used zoom you'd know how well inactive participants can follow the stream. just claims and PR images. Lmao.. Washington state is now basically patent troll country. And whoever authorized a digital court over zoom should be fired.. for being an idiot. The amount of legal problems this throws up are beyond imagination. For starters, how you even prove that someone in a zoom meeting is who he says he is? How you control that the jury actually looked at the controllers?

Or basically

They weren't arguing what's obvious or the validity of the patent.
The argument was if the patent had been infringed, in this case it had.

As for what a highly reimbursed team of lawyers thought to argue about, I'm sure they covered their bases for this particular lawsuit.
If the next blurb we see says Valve fired its legal team than I'll stand corrected.

Maybe they saw the writing on the wall a few years ago on this and abandoned the whole steam controller project rather than get blackmailed with an injunction. Like how rumble disappeared for a generation.

I got googled by Agent.X7 in the other thread, apparently SCUF makes expensive as hell gamepads.

They look pretty good, but are up around $200 for all the options added. I'm not sure how good their actual business is, but their legal team is killing it: SCUF has now won against Microsoft and Valve.

Valve can pay $4 million out of petty cash without even feeling it, but I feel like they have to challenge the ruling.

The jurors were mailed valve controllers. (Not scuf, and that was what i was referring to)
You don't have to make a product to defend your patent.

Obviously there was enough evidence to convince them that the Valve controller infringed on the patent.
If you read the patent and look at valves controller, it's pretty obvious.

There's several links in that patent page that I posted.
Blue has posted some other stuff so if you read everything and still feel the same way, not about the patent troll part but about the ruling.
I think the ruling is sound.
I doubt valve appeals.

Can I just point out that RULE 3 applies to you as well?

Aside that, either provide proof for your claim that they got SCUF controllers or I will ignore that, nowhere on the internet does it say SCUF sent controllers, valves counter-claim was literally that SCUF only provided fake images.

Ah, so the legal system now operates on hearsay... that's awesome for patent trolls.
Not a patent troll.
They make controllers.

Does it matter who makes the boulder roll? SCUF is not a patent troll, but they just opened the flood-gates with this for actual patent trolls
I'm sorry, but the patent troll floodgate has been open for a long time.
Obligatory IANAL, are you?

IANAL either...
I am just hardcore against weaponizing patents and digital courts, and especially these 2 things combined. Or explain to me how a controller that isn't made hurt SCUF, a company nobody has ever heard of.

Such an interesting case, first of its kind.
The eight jurors were each mailed a Steam Controller.
I wonder if they get to keep it.
