Blizzard Claims Ownership of Custom Game Modes

PC Gamer notes changes to Blizzard's Custom Game Acceptable Use Policy show the company will now claim ownership of custom game modes created by users. They say "Blizzard isn't letting the next Dota 2 slip through its fingers," referring to the rights to Defense of the Ancients, the MOBA game first created as a custom mode for Warcraft III: Reign of Chaos. Here's clause one of the policy:
Ownership Custom Games are and shall remain the sole and exclusive property of Blizzard. Without limiting the foregoing, you hereby assign to Blizzard all of your rights, title, and interest in and to all Custom Games, including but not limited to any copyrights in the content of any Custom Games. If for any reason you are prevented or restricted from assigning any rights in the Custom Games to Blizzard, you grant to Blizzard an exclusive, perpetual, worldwide, unconditional, royalty free, irrevocable license enabling Blizzard to fully exploit the Custom Games (or any component thereof) for any purpose and in any manner whatsoever. You further agree that should Blizzard decide that it is necessary, you will execute any future assignments and/or related documents promptly upon receiving such a request from Blizzard in order to effectuate the intent of this paragraph. To the extent you are prohibited from transferring or assigning your moral rights to Blizzard by applicable laws, to the utmost extent legally permitted, you waive any moral rights or similar rights you may have in all such Custom Games, without any remuneration. Without limiting Blizzard’s rights or ownership in the Custom Games, Blizzard reserves the right, in its sole and absolute discretion, to remove Custom Games from its systems and/or require that a Custom Game developer cease any and/or all development and distribution of a Custom Game. Please note that your Blizzard account can be subject to disciplinary action in event that you do not comply with Blizzard’s request or this Policy.

All of the hyperbole aside.... Here are the realities...
- They can put it in the EULA.
- It doesn't matter if it's enforceable.
- You live in the US, you have to buy your justice.
- If you create the next DotA on WCIIIr, Blizzard will hit you up thanking you, offering you a big check for your work and letting you know they already own it.
- If you resist, they'll sue the fuck out of you....and unless you have tens of thousands of dollars lying around, you won't be able to successfully defend it.
- And if you *do* successfully defend it, you'll be down tens of thousands of dollars rather than the hundred thousand they offered you originally.
- And this is why capitalism is a good thing.....but a horrific thing when it becomes the religion or centerline of your society.

The even better part is people will still buy their products, rewarding anti-consumer behavior, and filling their legal warchest further. Then they'll come on Blues and make excuses like 'free games' or 'gamergate incels' or 'buthurt over another launcher' instead of admitting that you vote with your dollars to support behavior like this.

I don't really disagree with any of that, but here's another reality: a very small percentage of players actually know or care who publishes any of the games they play. As has been pointed out many times, we here here at Blues and other enthusiast sites like it are in the distinct minority of gamers who care to be "in the know"; most gamers just want to play the newest or popular games. So me choosing not to play a game by Activision -Blizzard, Bethesda, Epic, Ubisoft, EA, 2K, Warner Bros, or any other publisher known for sleazy practices is a symbolic gesture that affects nothing beyond arbitrarily limiting what games I play. I just don't see the point. So I provide my tacit approval by refusing to boycott games by shitty companies. I just live with that.
What you're saying is that Bluesers are the organic vegans of gaming, and you want to eat burgers.
