They sure can. It's written very plainly in their ToS.

Sure, we know. They aren't going to do that though because much of Youtube is filled with "reaction" and critique videos that could be construed that way. They already reviewed his videos and determined it didn't meet the bar. As I said Crowder is a well known troll and knows how to walk the line.
