Fallout 76 Legal Fallout?

A post on Eurogamer attempts to sort through a tangle of information about Fallout 76 and the possibility of getting a refund amid complaints about a buggy launch for the RPG prequel. They note some claims of successful refunds are counterbalanced by complaints that refunds were denied for users who already downloaded the game, which seems like a legal Catch-22 for those who say the game is unplayable. They note that Washington D.C.-based legal firm Migliaccio & Rathod LLP is soliciting complaints, suggesting they may want to take Bethesda to court over this. Here's their statement:

Migliaccio & Rathod LLP is currently investigating Bethesda Game Studios for releasing a heavily-glitched game, Fallout 76, and refusing to issue refunds for PC purchasers of the game who found it to be unplayable because of its technical problems. While minor bugs and glitches are expected with the release of most new games, Fallout 76 launched with a 56GB patch that has proven to be but a starting point for the game’s problems. Gamers who have tried to receive a refund because of the game’s myriad glitches have been unable to do so since they downloaded the game, leaving them to deal with an unplayable experience until patches bring it back to a playable state.

I read earlier today that someone compared the script of the whatever-flying-nuclear-mutant-boss-creature in this game to a Skyrim dragon, and it's the same exact script.

That pretty much sums up to me the overall impression I've got from all the reviews (Angry Joe's especially), and various streams I've seen clips from.

I get that some people can find fun in what's there, more power to them, I personally don't want to reward Bethesda for this half-assed effort though.

Here's something that's controversial...there's nothing wrong with the game, what is wrong is the gamer outrage over a perception that was never sold as such to begin with. The game was sold as a spinoff title to stopgap the Fallout franchise while they develop the next entry into the series...it was sold as a multiplayer survival game within the Fallout universe.

I'll mention it again for good measure, watch this vid and then check your head. The only way I can understand how you could praise this game, mate, is if it's the kind of "playing game with girlfriend" where you have a constant boner and a promise that you'll get lucky in a couple of sexy minutes.

This is, by far, the most ridiculous string of words I've read lately....and really goes to show the level of maturity in your grasp of human intelligence.

LOL exactly. Ohhh and it isn't on Steam because they were afraid of refunds, because it would be cheaper to build a new client, servers, storefront, and whatever else that is entailed in that then give a refund. The haters of this game have some sound logic.

face it, the Xbox and PS4 just cant handle this game.

You are entitled to your opinion on Fallout76 but you're wrong about Mack and WAB reviews. There have been a number of games that I've bought specifically because of his reviews which are appropriately titled (WORTH A BUY). The most recent of which are Kingdom Come Deliverance and No Man's Sky. He isn't shy about pointing out the glaring faults with games he generally praises either, which only increases the value of his reviews IMO.

P.S. He is also one of the few (only?) reviewers that comes back to a game a year (or even longer) after release to see if he needs to change his verdict about the initial release.

I’m so disappointed in Bethesda in general. I mean, I was ok with their buggy releases in the past; at least the games were still fun. But this is the perfect example of “give an inch, take a mile”. Full triple-A price for this crap and gamers still buy it. What is happening?

Skyrim's mod-ability (and the fans' dedication to fixing their games for them) and scope allowed Bethesda to slug above their weight class for a while. But the reality is that Bethesda can't produce AAA games outside of their (already aged) engine. An MMO is not their forte.

Either Bethesda will learn to limit their scope to something more reasonable, or they will have to grow themselves into a larger or different studio (if they can)...
