Star Citizen Refund Refusals

Long-time backers of the Star Citizen project are no longer able to secure refunds from Cloud Imperium Games, reports Attack of the Fanboy. They note a Reddit post from a customer who sued to get a refund and lost in small claims court (thanks RedEye9). Word is that CIG is now enforcing a change to the terms of service that was made around a year ago that permits them to refuse refunds requested more than 14 days after a pledge, which this court decision upheld. CIG has now collected almost $190 million in funding from over two million backers since 2011 for a project originally planned for a 2014 release, which helps explain why some have lost patience that this has evolved into two different games still in the alpha stage of development. Refunds and other topics are part of an incredible new tweet storm from Derek Smart, as the outspoken skeptic of this crowdfunded space game offers analysis and criticism of various aspects of the situation. Here's most of the Reddit post discussing the court decision:

In mediation, CIG/RSI would not agree to refund the portion of my account not covered by the arbitration agreement.

Though lawyers aren't permitted, CIG/RSI lawyers drafted and submitted statements that were permitted.

The judge declined to hear anything about the conscionability or lack of consideration in the TOS.

Despite the top sentence on the TOS, CIG/RSI successfully argued that the arbitration clause should be applied to transactions even before the clause existed.

CIG/RSI repeatedly argued that there is a playable game and that funds have been earned, but the judge did not rule that either.

Following application of arbitration clause to transactions outside covered dates, court orders matter to arbitration, case is dismissed without prejudice.

Since it's estimated to be like 140 degrees F on average in 2250, might I suggest starting with the climate, Barron?
It will still snow at the poles during winter and that in itself will prove that global warming is fake news.

Full disclosure - as a child in NYC I used to put ketchup on my steak.

Whatever, Barron.
I doubt Barron has the ability or skill set to pour his own ketchup. His steak is already sauced and pre-cut in bite size pieces by the time he gets it.

Everyone wants their kid to get a good score on the SAT, but naming your kid after the prep company won't have an effect.

He's what, 12? I'm sure he's a fine kid. I doubt he'll be a fine adult, given what the others became, but at 12, he seems well enough.

He is, however, the only kid living in NYC that ketchups his steak, so I strongly suspect Prez is him from the future, come back in time to hide from the shame his name has become!

loomy thanks for your contribution I went and had a look at some lets play videos and it looks like the game is coming along ok. Actually reminds me in some ways of the early DayZ with all the bugs. I'm guessing something will eventually come out. Really makes the salty tears that much more delicious!

RE Cutter yeah the guy's nuts but he is a free thinker which I much prefer to the dogmatic ideologues who seem to be the most prolific posters on blues these days.

Come-on lets go for 100 posts!

I'm sure you find yourself a free thinker, as well, instead of one of the most predictable people here on any given social or political topic. Cutter being equally predictable, I may add. You say "free thinker" the reality is the person most concerned with his own self. You, on the other hand, will easily support something against your own interests if you feel it pisses off the right people.

Gotcha!

For the record, since 2015, I have WARNED that this is where things would be headed once it became clear that they could NEVER ship the games promised.
Yet all of the content shown so far is far in excess of what was originally promised.

Okay, can't let that one pass.

At no point have they delivered in full what they promised for the amount of money or time they said they needed. Never. As of right now you do not even have the experience promised you in the original kickstarter for $2M, let alone the $5M and $6M stretch goals.

Moreover, if you actually go and look at the original pitch, the scope of the game hasn't increased all that much since. A lot of implementation details have been filled in, and a lot of systems have been overhauled two or three times in an attempt to make them fit for purpose - all of which makes it LOOK like the scope is increasing, but by and large they're still chasing that original $2-6M goal.
