Crytek Suing Cloud Imperium

Crytek is suing Cloud Imperium Games in California District Court claiming CIG is failing to live up to the terms of their agreement to use CryENGINE to power Star Citizen, the crowdfunded space game. They say the license covers one game alone, and that since Squadron 42 is now a separate product, it would require its own game license. They also claim that their logos, trademark notices, and copyright information has been improperly removed from Star Citizen marketing materials. Gamasutra has a response to this from Cloud Imperium, who explain that this lawsuit is without merit since they took a page from the Duke Nukem Forever playbook and switched game engines:
"We are aware of the Crytek complaint having been filed in the US District Court. CIG hasn’t used the CryEngine for quite some time since we switched to Amazon’s Lumberyard. This is a meritless lawsuit that we will defend vigorously against, including recovering from Crytek any costs incurred in this matter."

Yeah, totally, but what about Chris Robert breaking his contacted with Crytek who help him get his kickstarter going?

That sounds to me like the kind of stand up guy that Chris is.

Hope this goes to court so we can see what as really happened.

It's hilarious. He's an absolute anus trumpet. Here are some of his pathetic predictions:

1) CIG would fold by January 2016
OUTCOME: CIG is still going strong

2) CIG Austin will close and be rellocated (stated in 2015)
OUTCOME: CIG Austin is still going and taking on more staff

3) If CIG made it to 2016 they'd announce the Xbox One version
OUTCOME: No console version

4) Planetary landing isn't possible and the technology is decades away
OUTCOME: Already playable in the 3.0 PTU test

5) Star Marine cancelled at CitizenCon
OUTCOME: Already released

He's jealous that Chris Roberts has achieved what he never could whilst his own 'games' are widely derided. All he wants is for the game to fail and he has started numerous campaigns to undermine the game. Fortunately nobody takes him seriously.

On a serious note, Derek Smart is clearly derranged and needs psychiatric attention.

Defendants utterly failed to follow through on those promises

After listening to a lot of Leonard French, here's my take:

This is what one party is claiming the other party did/didn't do. It's for the court to decide where the truth in the statement is.

Huh, isn't Lumberyard based on Cryengine after Amazon bought the engine after Crytek folded? I am confused.

And that aside, Crytek still exists? Good for them I guess. But what the actual fuck is this lawsuit? CIG uses Lumberyard not CryEngine, and even if they used CryEngine this isn't "really" CryEngine anymore after 90% of the systems had been replaced....

I would actually be really shocked if this lawsuit went anywhere. Whoever made that original engine contract must have been a fucking idiot if they did actually sign a "we don't change engine" clause.

Not really. According to the suit, CIG negotiated a significant discount from the usual licensing rate by promising to exclusively use Cryengine, promising to prominently feature Crytek copyright notices on launch, and promising to collaborate with Crytek by back-propagating bug-fixes and optimisations to Crytek. The deal was, essentially: you get to use our engine as a launchpad at knockdown rates, in exchange for which we are along for the ride PR-wise and tech-wise.

And yet, even a bare bones skeleton of a company struggling to keep afloat can be seen as the big bad villain trying to bully the little guy who's pulled in well over $100 million from the public without actually delivering anything besides magical moving goalposts.

I need to keep up with the daytime soap opera that is Star Citizen's development. Last I knew they were still using the skeleton of the Cryengine. The thing was torn down and reworked so heavily that it was practically its own new engine, but it still had Cryengine bones. Which of course again begs the oft asked question why use the Cryengine for a project so far removed from what that engine was designed for to begin with, but at any rate this seems to be just another case of CIG's dubious choices in Star Citizen's planning phase coming back to haunt them.

No. From a legal point of view Lumberyard is a different, independent entity, a new engine. Just like CIG bought the CryEngine, not licenced it, Amazon bought (!) the CryEngine code, has NOT licenced it. Lumberyard is Amazons baby, regardless of its technical roots.
