Maybe in your neck of the woods, in mine too. In the US, it requires a higher standard. This doesn't meet that standard, if you believe otherwise then it's simple. Prove it, because you're going to have one hell of a time getting around the case precedents that say otherwise.

The thing is this isn't just a prosecutor trying to make a name for themselves, this is also a case of the judge creating laws from the bench because of agenda surfing. The current hot topic agenda: "cyber bullying" of course.
