It's just a poorly written law in that it doesn't allow the court to consider the person's intent in recording, only the nature of the recording itself.
It's up to the legislators to fix that, the judges hands are tied. Poorly written laws and people getting off on technicalities are everywhere, not just in Tennessee. |
