Duke Nukem Lawsuits Settled

A statement on the Gearbox Software website shows that the lawsuits over the rights to the Duke Nukem IP have been settled, and the lawyers for Gearbox, Interceptor Entertainment, and 3D Realms are all now in the hot tub toasting their success. There are statements from all the involved parties, with 3D Realms saying they didn't realize they weren't entitled to license an IP after selling it off, that Interceptor is still developing Bombshell, and that Gearbox has voluntarily ended the litigation, satisfied that they've proven ownership of the Duke IP. There are hugs all around, and the goodwill everyone expresses makes a mystery of how this ended up in court. Here's some of the love:
Gearbox Software appreciates the sentiments from Interceptor and 3D Realms' representatives. Gearbox Software President Randy Pitchford said, “I genuinely appreciate Mr. Nielsen’s and Mr. Schreiber’s statement and sincerely offer my best wishes to Interceptor Entertainment and 3D Realms towards their future success and, as someone who was part of the 3D Realms team when Bombshell was first imagined, I am excited to see what they have in store for us with their game.

Just like the battle between Interplay and Zenimax over Fallout Licensing. 3D Realms and Interplay both got to keep the old shit... but can't make anything new (Interplay was trying to make that FallOut MMO)

"The problem was that Reloaded, in its then present state, was both a prettier and better game than Forever was. So they [Gearbox] could under no circumstances allow us [Interceptor] to publish it, show it, or do anything at all with it, because it would destroy the sales-opportunities they had left in Forever."

Basically Gearbox/Randy being pikers to make a buck off Forever.

A Duke Nukem reboot in the Unreal engine would rock. Those screenshots look fantastic.

I am currently playing early access Black Mesa (and loving it) while I patiently wait for HL3. Blank

I worked on that, and it was pretty cool. Of course, DNF was Unreal (2).. but we were working on that in UDK/Unreal3.. it was a lot of fun to work on. And several of the people who were not professional game developers prior to that have gone into the business now.

The thing the media almost never mentions about this case is that when 3DR sold the rights to the IP, they still reserved certain rights. Such as the Duke movie rights, the rights to all pre-DNF Duke games and the rights to complete certain specified Duke games. Including a game called "Duke Nukem Survivor". They maintained that Duke Nukem Mass Destruction WAS the Survivor game.

Will probably see Duke Nukem 3D Reloaded released in the next year or so. Sales of DNF have tapered off as of this year and if anything 2K may figure that Reloaded could be a good deal and possibly even cause a spike in DNF sales as well by exposing a younger generation to the classic Duke and then scamming them into getting DNF.
