Considering its an upgrade in most cases and not a fresh install and this is 2015, I don't think its an unreasonable expectation. At least where possible.
Oh I don't think so either. It's just not out of the ordinary, which is probably why MS figured they'd get away with it.
It's funny - my housemate just built a new machine. First thing he did after installing Windows 7 was open up Internet Explorer to download Firefox. Then he removed the IE icon saying "And that's the last time I'll be using that."
