So, these people claiming they should be employees because the company does a background check and expects a certain level of behavior...
That's every company with contractors. If the suit wins, it should require any company with contractors to make them official employees. If Uber uses that defense, they'll have a ton of support from several companies. Just because these people can't get a job and WANT to be employees and not contractors doesn't magically allow them to be.
