We can test for it as part of field sobriety testing.
Driving conduct, odor, have it on your person, admitting to smoking recently (most don't know it is against the law to smoke and drive), field testing, all of these things will give me reason to test the driver.

Arresting people for it is becoming more common.
...

Don't take this the wrong way: I'm the most boring human being on earth. No alcohol or anything else. And I trust our boys and girls in Blue.

Anyway, where-as alcohol consumption is pretty straight forward... wouldn't this be more subjective? So can't this one be abused by untrustworthy folk? I'm asking an honest question and not trying to troll.

Sure, if your cruiser-cam caught them driving all kinds of crazy on the road... then yeh they're screwed. But...

Odor could be because someone came from a party and now their hair wreaks. Perhaps that's the reason they left.

Similar to testing surfaces or whatever... they were at a party and left.

Similar hair or urine test might just back up the above.

You have the officer's report as to whether your eyes are dilated and such. Which could be... skewed.

But if it was something like swerving to avoid an animal (and thus crossing the line)... the cop pulls you over and smells that... even if you're fine aren't you screwed?

I know nothing about the testing... whether it's "any amount what-so-ever == positive == screwed" vs a level/ratings think like alcohol. Or really anything involved "that" whole thing.

Again, I do not do anything or saying "cops are [blank]." And if I even THINK there's a chance I'm gonna drink I arrange to be driven.

Just saying... isn't the line a little blurry on the above
