Duke Nukem 3D: Reloaded on Hold

The Duke Nukem 3D: Reloaded Website has an update from a few days ago that this Unreal Engine 3 remake of Duke Nukem 3D, which was coincidentally first mentioned here exactly one year ago today, will be completed "at a future date that is yet to be determined" (thanks Mad Max RW). Though the remake was going forward with the approval of Gearbox Software, owners of the Duke franchise, a follow-up post on their forums from the project lead indicates they may have made this decision out of a dispute with Gearbox over how the project was being handled:
We are around 90% finished with the current Multiplayer version - But you have to remember, that we don't own the game. Its done under a signed license with Gearbox Software. Which ultimately means, that we cannot do whatever we want with the project.

Its not really up to us. We have had a long conversation with Gearbox about this matter. And the fact is, that we are bound by a license. A license of an IP owned by Gearbox Software. And we can't do much about it.."

We haven't given up - By far! This team is extremely productive, and we were actually in the final phase of the game, slowly starting our Beta phase.

But there are some conditions which we can't live with, with our license and agreement. And because of this, we have decided to put the project on hold.

This might change in the future - it all depends on what Gearbox decides to do, after the DNF DLC has been released.
Update: A subsequent post stresses that shelving the project was the development team's decision, and not Gearbox's.

Attorneys do what they're told. The attorney created the original license that these guys signed. Someone else made the decision to enforce whatever clause is being used to terminate. Since this was licensed, and assuming it was going to be sold and not released for free, it would have been free money for Gearbox. Someone else decided this wasn't worthwhile, not an attorney.

As the story clearly stated even before the update, the development team put the project on hold, Gearbox did not order them to stop.

Makes it sound like yes, the dev team put the project on hold, but because of a decision Gearbox made. If Gearbox decided to charge the dev team a pound of flesh per person in order to release, and they chose to put on hold, whose decision really caused that?

Gearbox is holding their feet to the fire on some decision that we don't know. Is it a good decision? Maybe. Maybe Gearbox is trying to force them to do proper QA and they're unwilling, so Gearbox is doing the right thing. Maybe Gearbox is asking for something unreasonable and therefore Gearbox is being "greedy."
I'm just saying it's likely a Randy decision, not an attorney decision.

I think it would have given the exact opposite, in providing them with constant momentum and motivation. Once you get something out to people, that interest drives you and attracts additional modders to the team.

They can always go back and update the first release stuff down the road...but a mod this robust, 7 years later and still not even a teaser...mod is dead until a release proves me wrong.

I'm not sure they'd have been able to maintain momentum with a chapter-based release cycle. However, they certainly should have separate singleplayer from multiplayer, and they could have split the singleplayer campaign into two. That would allow them to focus on the basics and put out a solid product.

So yeah, they've completely lost the momentum they had behind it and by the time they actually get around to releasing it Valve will probably put out something new in the HL universe. Don't forget what happened to Fortress Forever - that was looking good but took so long it ended up coming out within a day of the TF2 beta. That destroyed the community following and cost them big time.

There is no news on Black Mesa. It's been dead in the water for like 2 years. They claim development is still ongoing, but reality is, they claimed they were releasing it by the end of 2009 and that was 2 years ago.

I've always said, as soon as they announced it, they need to focus on releasing "chapters", a few levels at a time. But no, the team leader came out publicly and said they wouldn't do that and would only release the mod as a whole, all at once. Then they said multiplayer replicated from Half-Life would be included, all modes.

Talk about biting off more than you can chew. Dark Forces mod (for Quake 2 then Jedi Academy) suffered the same fate, but at least they managed to get a few levels released in a demo.

I should have clarified...I meant to say it must have been something that gearbox attorneys must have required that caused such a reaction.

I've been looking forward to this so I hope they start back up again some day. This looks sooooo much better than DNF, which looked and felt like a pre-alpha only 6 months into development, if that.

They should switch up a few elements in the MP demo to remove references to duke and release the MP beta under a different name. Screw gearbox. If gearbox cared at all about restoring the franchise they would be pushing this forward and out as fast as possible. There is almost no good will towards DNF and gamer's have a very sour taste in their mouth. The classic game still has it's fans and supporters (as well as an active mod community to this day). After the disaster which was DNF - the IP owners really need to show the community some love. They were doing this by allowing a community project to get developed - at no cost to them - under license and released for free. I have seen some leaked shots from the game and it looks miles better than DNF. These guys are real fans and they have real talent. Maybe that is part of the problem: Will a major developer allow themselves to be totally upstaged by a group of dedicated fans working for free?

Reloaded was always planned as a free download for PC gamers. It was also being developed without pay (unless you count the donations from the public which are now being returned).

Ultimately what's going to happen is the dev team responsible will use the opportunity to start their own legit game for sale through digital distribution. A couple years from now if "Interceptor Entertainment" still exists, one possible way to look at it is they used Duke Nukem to gather a team and get attention and donations, wasted a year answering to Gearbox, then moved on to greener ($$$) pastures.

I remember them getting the blessing of Gearbox, but still it's their sandbox you're playing in.

Of course they probably did a bang up job that makes DNF look bad, which from what I've seen and read it probably wasn't that hard.

Gearbox was afraid PC gamers would rather wait on a free Duke Nukem game than hand over $50-$60 for another one of their letdowns.

DangerDog, Duke Nukem Reloaded was granted an official license from Gearbox a year ago.

This is why if you're going to do something naughty like use IP that you don't own then keep a lid on it till you ready to release and then just "put it out there" mysteriously and most of all anonymously.

It's not like you will ever get any money from all your hard work, if you're just doing it for the "fame" then you're doing it for the wrong reasons.
