Take-Two Sued by Former QA Tester

Take-Two is being sued by former QA tester Aaron Martinez, who accuses Take-Two subsidiary Visual Concepts of failing to provide legally mandated breaks and overtime pay. VG247 sums up the details in the case, saying the plaintiff is asking a California court to designate this a class action, stating "over 400 employees were not compensated for overtime and not provided with lunch breaks." They also have Take-Two's denial, saying the plaintiff "fails to state facts and is unable to state facts," and that the firm compensated employees "at the legally required rate for hours worked in excess of 8 hours per day." This includes reporting from NeoGAF, Develop, and Edge.

This type of thing seems all too common in the industry despite how some people are tripping all over themselves to handwave it away. I wish him the best, some of these companies need a wake up call when it comes to organizational planning.

Which is idiotic. Ok, maybe not the laying off necessarily - if you're a smaller studio it will be months before you need a large test team again and you have to let some people go.

But working them that hard? After a while the brain goes numb and you start missing things. Especially in testing, which is repetitive work. Imagine playing the opening level of Deus Ex for 12 straight hours...

More testers with fewer hours > fewer testers with more hours.

Take Two should be sued just for paying QA testers anywhere near minimum wage. They must be picking up idiot kids off the street instead of hiring people who do QA engineering work for a living.

There are two kinds of QA employees. Your first kind are very skilled and really know how to test, how to break and how to diagnose. These skills need to be learned, though, and you learn it by being the second kind. The second kind are people that like games but know little about making them and are just playing the same way anyone else plays - looking for bugs.
People who do QA engineering work for a living don't grow on trees, and they're not common. You need to hire a whole lot of people to play your game, and those that show an interest and a knack get promoted. From there, if they show the skills, they will be promoted into design.

But yeah, QA guys, at least the lesser-experienced QA guys, should be exempt employees. These guys have very important and very challenging jobs but they're essentially the warehouse workers of the industry - easy to find, easy to replace, quick to leave, and occasionally absolutely amazing and worth holding on to regardless of what happens. I don't mean to downplay the importance of very good QA testers, who are some of the most valuable and valued employees, but the less good ones come and go so often.
