Yeah I don't think he ever got private funding. That screamed SCAM from day one.

Ehm, so basically you complained for getting something of equal quality cheaper? Because that's what you did. There is no physical difference between OEM and RETAIL, but for the seller you mentioning this in amazon reviews brings up a huge legal issues and potentially blacklisting from Amazon store.
Also, it's pretty weird customer behavior to complain about that.. considering the seller saved you actual money.

Alas, we're stuck with em both, and I must confess, I really dig those Samsung phones for a number of reasons.
-Micro SD card expansion VS. paying for overpriced system memory on Apple.
-Android being emulator and "hands-on friendly" VS. Apple closed OS ( Much like the old Windows VS MacOS arguments ).
-Easy to find and bigass long lasting quality easily swappable batteries. ( see zerolemon.com ).
And the list goes on and on.
OFC some people are better suited for Apple's offering, but I ain't one of them. Even if Samsung's phones hadn't any of the so called infringing features, I would still have chosen an Android phone for the aforementioned reasons and Apple's buyers would still have chosen Apple phones. This court case is a non-issue.

Cool, now all the hipster Windows 8 haters have something new to complain about. The general hipster uses Mac OS X for their desktop (because they've abandoned Windows), and Android phones because the iPhone is too "mainstream". So now what will they do? Switch to Chromebooks? Yup! lol
