#15:

>>"There is no legal "journalistic right to privacy", there are only legal precedents which a judge can either ignore or accept.

If you want to protect your source, you can only plead the 5th and then state your reason for doing so."

Sorry but wrong on both counts.

The protection of the source (thank you, my brain stopped working) clause does not count in a case where libel and slander are proven, correct. However, Infinium first would have to prove without a doubt that the article was done solely with the purpose to libel the people at Infinium. As HardOCP reported on facts as they existed at the time of the article, as well as have refused to comment on the article despite requests BY HARDOCP for corrections so they could supplement their article (according to HardOCP -- see this:http://www.shacknews.com/ja.zz?id=9405301 ), Infinium is going to find it near impossible to prove this. And as they will not be able to do so, HardOCP has more than enough legal right behind them to protect their source(s)' confidentiality.

The fifth amendment protects against self-incrmination. Nothing more. This has nothing that would fall under that, because the HardOCP folks have done nothing that would be self-incriminating that would be presented in court. (It's not a murder trial, or anything of that nature.)

This is an expose, no different from the Dallas Observer articles about ION Storm back a few years ago. All information is/was factual at the time of the article's "printing". Honestly I don't see Infinium as having a case, especially under the definitions of slander as put forth in the AP Style Book (which uses all available court rulings on the subject as its point of reference). IF they can prove things have changed, they can possibly force HardOCP to write up and add a correction to the article.

The most Infinum can do really is try to force HardOCP to divulge their sources, but as this is an article presented as journalism, more than likely this can be avoided by invoking journalistic right to privacy, or however it's worded officially (my brain is mush right now).

The problem is that rockstar already bowed to to pressure from the Haitian-American community, so they've kinda set themselves up for anyone who has even the slightest beef with them to deman concessions from them hand over fist.

Next thing you'll see is a motor-scooter manufacturer take them to court because they besmirched their good name by calling a scooter the "Faggio" in the game...

"Hehehe I don't feel sorry for him or Valve.

Just wish it was a beta or something that got leaked in stead of source code "

Nice. Good to know some people don;t give a shit about the livelihoods of the 60 or so people who have worked on this for the past four or five years.

Oh lordy.

And on EvilAvatar yesterday, they were telling people they had confirmation it was the real one and all would be okay to download it.

That site always makes me laugh with schadenfreude-laced glee.

>>"Well I hope the motorcycle is easy to drive.. "

I'd guess with the sidecar it will be stabilized enough to handle somewhat as the jeeps are.

I REALLY hope they have the sidecar mounted machine guns, like this '44 BMW R75M... http://www.bluemooncycle.com/Existing%20Site/R75M.html

(By the way, that bike's for sale at a shop in Atlanta.. The gun's a replica, so not so useful in traffic jams, but... )

>>"Now, the jetpack, that's just silly"

Not really, it was an experimental "aircraft" that the German flirted with, like their so-called "flying saucers" and some of the other jet aircraft.

I'm just wondering if the maps will get signifcantly larger since these early jets were all about speed, but not necessarily manueverability...

>>"They are only creating all these new weapons cos of the war in iraq, sort of trying to cash in on modern tecnology and then selling it to the kids

Its like this: we all see stealth bombers in iraq on tv so when we see it in a game we are supposed to say 'thats sooo coool maaan' and rush out and get it as soon as its on the shelves. and in the rush of excitement we all forget thats the game is actually based in 1944, duh!"

You REALLY need to read some history or watch some History Channel (brought to you by the letters WWII!) before spouting off like this. These were ALL in existence or prototypical during WW2... they have nothing to do with the war in Iraq.
