Okay, the hardware replacement thing possibly is a bit of an exaggeration - may be its every year instead of every few months. Just an example, I tried the crisis demo on my 8600-equipped MBP booted in to XP, and it stuttered horribly.

With consoles, I don't have to look at the back of the box to see if it will run properly and smoothly, or go hunting for patches. As long as I get the game for the proper console, it will run. The only decision I have to make is whether I will enjoy the game or not.

This is a tired old argument, but here is my worthless $0.02 anyway. I used to be all into PC gaming. But work, school and family life means I simply don't have time any more to futz around with tweaking registries, drivers, and buying $300 cards every few months and replacing my mobo and processor every year in order to play the latest games.

Outside of a few exceptions like Orange Box and COD4, I have not played or seen any PC game in recent memory that really stood out in some way. I download demos to check out some games, but ultimately see nothing worth forking my money over. I was not impressed with Bioshock (still does not compare to System Shock 2 outside of graphics) and Crysis was utterly boring in terms of gameplay. I was disappointed with Supreme Commander.

Now I have a Wii, and while the graphics are not there, I am having fun. Metroid 3, Mario Galaxy, Wii Sports, RE4 Wii, Lego Star Wars and many of the GameCube games I missed out on, not to mention the downloadable VC games, are so much fun to play. Just pop in the disc and start play right away. PC gaming just does not have that. Sure there are some complex games and KB/mouse. But I play games to have fun, and the current generation of the Nintendo consoles provides that in spades - FOR ME!.

sorry but its not that cut and dried. if it were many games that are more than 4 years old would be released under a GNU...as it is 99% of them aren't. There are legal precedents where an intellectual property can be forfeited simply due to a company's lack of maintaining a financial interest in said IP. Its a similar legal loophole that property owners can fall victim to. Let a neighbor store his shit on your property which borders his and he can petition the court to have it turned over to him (it's not that simple of course but thats the gist of it). The issue you refer to in terms of real property is adverse possession, who requirements are - most state require that the possession be open, visible, or obvious so that the record owner (the owner shown by public records) can recognize the possibility of losing the land. Most states have a statutes of limitations so that adverse possession must last for the time required by the statute, also known as limitation title. Historically, adverse possession lawsuits have been filed involved a family relationship between the claimants, and permissive use among close family members.

So if some stranger/neighbor "stores his shit on your property" as you put it, means nothing. It has to be non-permissive use - that is, you never gave any such permission, it has to be out in the open, not hidden, and finally, depending on the state, has to be for a number of years. If you gave permission to your neighbor to store his stuff does not mean he can now claim the land.

As it pertains to intellectual property, rights to such property are created under the Constitution of the US, under Art. 1, Sec. 8, Clause 8. And is it pertains to your post about games, it pertains to copyright law, which falls under 17 U.S.C. Section 102 (Copyright Act).

When you are referring to intellectual property being forfeited simply due to a company's lack of maintaining a financial interest in said IP, you are referring to abandonment. Abandonment of Invention: To relinquish rights in an invention. An invention is considered to be abandoned, if within a reasonable time after the invention is completed, no actions are taken to make the invention publicly known. Abandonment pertains mainly to patents and trademarks, not copyrights.

In the domain of copyright, abandonment is recognized as the explicit release of material by a copyright holder into the public domain. However, statutory abandonment is a relatively unclear area of copyright law and the more common approach is to license work under a scheme that provides for public use rather than strictly abandoning copyright, in this case, the GNU license you reference.

Specced out a Dell Inspiron 1520 in the US store similar to the lower spec MBP 2.2 and the price came out to $1832, vs. $1999. Hardly the 50% or 30% price differential you claim.

And the Macs come with 1 year warranty standard.

I thought Bungie was bought out by Microsoft. As in, they are now a wholly owned subsidiary of MS. If so, I can see a lot of the key development talent leaving and forming their own studio (like those Blizzard employees did), but I do not think Bungie can up an leave Microsoft.

Guess we will find out in the next couple of days.

The last couple of patches have improved performance exponentially. I can now actually play a complete game w/o my (admitedly old) computer crashing to desktop.

New units were promised, but not weekly. I am sure they will introduce some once all the bugs and performance issues are dealt with.
