Gibson frets retailers with Guitar Hero patent suit follows up on news that
Gibson sued Activision over Guitar Hero licensing ( story),
inspiring the inevitable countersuit ( story). The new suit by
Gibson actually targets retailers selling Guitar Hero games. Gibson's statements
about this express regrets that this matter has come to this point, while
Activision's response calls this "a transparent end run around an impartial
court." The story also cuts to the heart of why Gibson is suddenly litigious
after three years of their products being represented in the Guitar Hero games,
quoting Activision saying they were "not interested in renewing its marketing

Ubisoft announces they have purchased the name Tom Clancy from Tom Clancy for
the royalty-free creation of future games (so presumably the author won't have
to get new checks printed for his personal life). Interestingly, besides video
games, this also covers "ancillary products including related books, movies and
merchandising products," so we will possibly see movies as a result of this
deal, not to mention more Tom Clancy books not authored by Tom Clancy. The
announcement is intentionally obtuse about financial arrangements, but on the surface it looks like this entails an up-front payment of
around 20 million Euros, with additional payments to follow over the next two
years: SAN FRANCISCO – March 20, 2008 – Today, Ubisoft, one of the
world's largest video game publishers, announces that it has concluded an
agreement with Mr. Tom Clancy to acquire all intellectual property rights to the
Tom Clancy name, on a perpetual basis and free of all related future royalty
payments, for use in video games and ancillary products including related books,
movies and merchandising products.
The price of this all cash acquisition is not currently disclosed. Post
acquisition, Ubisoft expects to have a net cash position of around 130 million
Euros by the end of fiscal 2007-08, compared to a previous expectation of
approximately 150 million Euros. Additional payments will be made as well in
fiscal 2008-09 and fiscal 2009-10.
On the basis of past performance of Tom Clancy branded video games, and
excluding any potential contribution coming from sales of ancillary products,
the royalty savings generated by this acquisition are estimated to have an
average positive impact on Ubisoft's operating income of a minimum of 5 million
Euros per year.
"After ten years of a highly successful collaboration which has seen the
creation of blockbusters that set standards in the videogame industry, such as
Tom Clancy's Splinter Cell, Tom Clancy's Ghost Recon, and Tom Clancy's Rainbow
Six, today, acquiring the perpetual property rights of the Tom Clancy name for
video games and related projects is a major event,” stated Yves Guillemot, Chief
Executive Officer at Ubisoft. "The future of our industry lies in our capacity
to create and develop brands that captivate consumers and that present a myriad
of opportunities for the full spectrum of entertainment, be it video games,
books, movies or other media. The Tom Clancy brand is recognized around the
world for offering exciting video games, films and books. The most recent
example of such value creation through brand management is the EndWar book,
based on the video game story, which has been in the NY Times top 10 Paperback
Mass Market Fiction bestseller list for the last four weeks. Capitalizing on the
strong franchises that we've built over the past 10 years, we will take the Tom
Clancy game brand to the next level of the global entertainment
industry."
Rock Band
Software Update Finalized on the Rock Band Forums has word on a patch for
Rock Band that will add an in-game store where new songs can be previewed and
purchased, while also addressing some vexing issues in both the Xbox 360 and PS3
editions of Harmonix' music/rhythm game. Changes that have been demanded by the
community are included, such as revised fan caps to allow bands to travel
farther at lower difficulty levels and achieve one million fans in "hard" mode,
fixes for PS3 microphone latency issues, faster loading of downloaded content,
and improved phoneme recognition for singing (which was previously broken at
best). Word is the update as been "finalized," and
this press
release, focusing on the new in-game music store and the fact that the game
has sold six million songs in three months, says to expect the patch this week.

GamesIndustry.biz has more quotes on the state of PC gaming, this time from
Steve Nix, id Software Director of Business Development. Nix feels some of the
hardcore PC gaming audience is shifting to consoles, something id cannot
ignore: "There are plenty of people who are diehard mouse and keyboard
guys that may never go to console, and also right now, if you have the highest
of high-end PCs, you're generally going to get a better visual experience," Nix
said. "There's no console out there that's as powerful as a God machine right
now, with a Quad-Core and a GeForce 8800 - it's very hard for any console to
compete with that."
"So you still have PC players, and some players are just console guys, but have
players moved over? Absolutely. We love PC gaming, and we continue to support PC
gaming - but you can't ignore the market realities and the size of the console
market these days."

Happy sweater day! That's right, the birthday of late children's TV host Fred
Rogers has been dubbed by someone or other to be sweater day, and today would
have been Mr. Rogers' 80th birthday. It's also the first day of spring around
these parts, but that doesn't mean it's too warm for a sweater, so I am
celebrating both occasions simultaneously.
