More EA/SecuROM Lawsuits

GamePolitics reports on two different class-action lawsuits filed against Electronic Arts last month in the U.S. District Court for the Northern District of California over EA's use of SecuROM digital rights management. One suit (Adobe Acrobat-format) was filed by Richard Eldridge of Pennsylvania over the inclusion of SecuROM in the Spore Creature Creator Free Trial Edition, complaining SecuROM cannot be completely uninstalled, and that the EULA for the product contained no warnings about DRM. The other suit (Adobe Acrobat-format) is from Dianna Cortez of Missouri, a player of The Sims who claims SecuROM caused problems that could not be fixed without reformatting her system, accusing EA of "unfair business practices." These are the second and third such legal action of which we've heard, as a federal lawsuit filed in September also complained of the stealthy manner in which SecuROM is installed.

I still think these lawsuits are frivolous and wasteful. Yeah Securom sucks but I find this absolutely ridiculous.
Litigation is the only way that works besides not buying it.

Agreed. When has SecurROM stopped pirating of games? All they have to do is download game, install crack and play. They are the ones who don't have to worry about DRM, they are the ones who don't need the DVD to play and they don't have the crappy stuff installed without permission.

These lawsuits are great, and you knew they were overdue. I have zero problem if a company wants to employ some DRM with their product, I just want to be informed that it exists so I can make the choice of not buying it - which I won't. And if even if there is some exceedingly rare case where I would, it shouldn't interfere with the product in anyway and be easily, and completely removable at any time.

lol, I certainly wouldn't go that far. The original release of The Witcher was plagued by long loading times, design annoyances and Tages copy protection - it was released too early and only through patching and an eventual re-release did they get it right. They're better than most but they've not done enough for us to properly judge them. Personally I'm more impressed with what Valve has done with Steam and with gaming, though I'm not naive enough to think they can do no wrong.

Yeah, and I'm sure that's right.

I was trying to get at the point that there were a few games I would have liked to buy but didn't because I couldn't remember which games had what kind of draconian bullshit DRM.

Out of the titles I listed I really wanted to grab the Witcher, but I knew that the first one was pretty light on the DRM but couldn't remember if the Expanded Edition was all fucked up or not.

And on top of that, my deciding factor for the Witcher didn't involve DRM, it was remembering that I'd read that they censored the NA version for the 'prudish' Americans. So I'll buy it online and have it shipped. I don't see why Canadians should get censored shit just because the Americans can't handle a little bit of T&A.

As to the whole point, I'm standing in Walmart with money in my pocket and want to buy a game. Why should I have to piss around trying to remember which game has the worst DRM?

I don't.

I didn't.

I bought a super violent movie and was quite happy with it.

I'm happy about this.

I wanted to buy Bioshock last year but couldn't as I didn't have an internet connection.

I was in Walmart the other day and saw Dead Space, Fallout 3, spore Mass Effect, the Witcher and Bioshock and really wanted to make an impulse buy. Instead I bought the Rambo 4 DVD (it was fun!). Whatever.

I realize that F3 doesn't have mass hassles or the Witcher is missing some content due to the USA's prude code. But I couldn't remember wich ones were out to fuck me over.

Go sue them, my not buying anything doesn't seem to work. Of course I doubt the suit will.

I'm buying a fucking GAME for fucks sake, not some kind of world destruction software that can only be used safely in the hands of the NSA/CSS or the guys that run Area 51.

Can't beat "DRM Free".

Yeah... they're old games... but considering most of the crap that's come out on the PC over the last couple of years (Talking about the console ports), I rather buy older GOOD games, all patched up, and no fucking BS DRM hoops to jump through. Another benefit is I don't have to upgrade my fucking hardware!

There's 18 games on my list... That's more games than I've bought in the last 3 years (Including bargain bin shopping during xmas).

I really hope GOG takes off and builds a huge library. Maybe that will show EA and other publisher's the way to go.

I agree that any and all software installed should be clearly labelled on the box, DRM included. Nothing like a big, fat symbol saying "SecuROM Inside!" to put people off. Maybe then something will be done.

In any event, it'll be interesting to see where these law suits go. I've outright refused to buy two games recently due to SecuROM alone (Red Alert 3 and Far Cry 2 - I haven't considered Fallout 3 yet due to a Left 4 Dead obsession) and I honestly wanted to spend money on them. Make it stop!

Hammer these guys to the wall. EA deserves to lose a few rounds in the courts. Then maybe they'll quit trying to police everyone and releasing crappy products.

But I doubt it.

While I'm not a big fan of frivolous lawsuits, money (or the threat of losing it) is the only thing publishers will listen to. Hopefully more of these lawsuits will happen and EA will realize that their DRM (which gets cracked immediately) is not worth the hassle.

Of course piracy is a smokescreen because every title available has been pirated and is available on a torrent site - DRM hasn't stopped that and just encroaches upon the ability of legitimate users to play the games they've paid for.
