Out of the Blue

Well our phone problem was cleared up yesterday, so thankfully this won't end up being one of these protracted mysteries. A different technician came to check things out, and thankfully he started from scratch, so he was not distracted by the previous tech's misdiagnosis. It turns out that there was a short in one of the phone wires in my office... the problem cleared up when I unplugged everything from the jack, and when he asked me if I had a splitter plugged into it I had to laugh, as this one jack has a three-way two-line splitter, which has a two-way splitter plugged into it, as well as a couple of DSL line filters, and of course, a whole bunch of wires. The silliest part of all this is that when I figured out which wire it was, I traced it around to, well, nowhere, as it was not even plugged into anything. D'oh!

I sent the following to them.

To whomever this may concern,

As a buying consumer I have been really frustrated with the use of DRM in video games.

As a recent example I purchased Spore. In an attempt to curb piracy EA has implemented draconian DRM that goes against every basic business ethic. In no uncertain terms the version of DRM EA implement in Spore basically says,

1. I am a thief

Apparently nobody told EA that pirates can still get around DRM. They always get around copy-protection. The version of DRM they used basically punishes the buyer.

2. I am renting Spore for the price of a full game

DRM restricts the game to no more than three activations after installation. These activations cannot be reclaimed if the game is uninstalled. Gamers constantly upgrade hardware or buy new computers. Some suffer from hard drive crashes. All of these are common among PC gamers and yet DRM only allows three activations.

3. EA will install spyware/virus on my computer whether or not I want it

DRM is an aggressive form of malware that slowly consumes system resources. DRM installation occurs during game installation without the buyer's consent. DRM also talks back to a main server.

4. EA does not guarantee I will be able to play the game I purchased in a few years

It has been well known for many years among gamers that one of the problems with server activation is that if the authentication server is shutdown by the publisher a customer cannot play the game they paid full priced for. While this might be acceptable with online-only subscription games, such as World of Warcraft, for single-player games online activation is incredibly problematic.

For years consumers have been fighting back against DRM with grass-roots guerilla tactics. A recent visit to Amazon shows Spore has nearly 2,000 user submitted ratings with more than 90% at 1 star. Most are complaining of DRM as the primary reason for the rating.

Unfortunately this carpet-bombing campaign is half-hazard. As a collective we gaming consumers can only do so much. What we need is a non-profit organization to champion this issue for us. I was hoping your organization could assist us. Please help!

EFF has long been an opponent of Digital Rights Management, as you can see in the following posts we have made to our Deep Links blog: <http://www.eff.org/related/3495/blog>. We have also opposed Blizzard Entertainment's stance on the ownership of software <http://www.eff.org/deeplinks/2008/05/do-you-own-your-software-wow-glider-case-not-just-> and <http://www.eff.org/deeplinks/2008/07/you-bought-it-you-dont-own-it> -- as you can see in these links, we have not always been successful in our efforts. The DRM in Spore has also been the subject of considerable discussion at EFF, though we have not yet made any public comment.

We have done a great deal to protect the rights of gamers and we will almost certainly continue to do so when it falls within our mandate as a digital civil liberties organization.
