Seller accountability - it is next to impossible to calim anything against a seller if they aren't honest about something.
Depends. If they lie on the disclosure form then they're toast (if you can prove they lied; obviously that can be difficult). And if the realtor knows they lied, then they're liable as well.
Georgia is a bit better about these kinds of things, but it leads to some wacky results. For instance you will never find anyone listing the square footage of a house on any of the MLS services (and only the foolish FSBO's will do so either) because it's very easy to sue over a misrepresentation of square footage here, and there's no hard or fast rules on what is or isn't counted. You'll find it on the tax records, but even that's meaningless.
Slash agent comissions - other than the paperwork, the agent really has nothing to do
In theory; in reality they still serve a vital role. Are you going to let anyone wander around your house without accountability? I sure as hell wouldn't. I may not know the buyers or their realtor, but if something goes missing or gets broken/damaged, then I can go after the realtor and they know it. They also make sure you get all your ducks in a row for selling the house, that you don't do something stupid (like, oh say, violate Equal Housing laws, or do things like list sq footage in Georgia), etc.
And I don't know about your MLSs up there, but down here you can forget about getting into one unless you're a realtor. And the various websites (like www.realtor.com, or www.insertrealtornamehere.com) don't have anywhere close to the amount of data available as the actual MLS does; nor can you execute arbitrary searches (as much as I'd love to... I could've narrowed things down a lot more if I was able to do a raw SQL search).
I do think comissions could be reduced though -- they've come down some in the past few years (they used to be 7%; 6% is now standard), but I suspect they could go down further, to at least 4%. Realize that the commission gets split four ways (seller's realtor, seller's realtor's firm, and buyer's realtor/firm), but even so...
