GameDaily has a response from Kyle at [H]ardOCP to yesterday's threat of legal action from Infinium Labs LLC (story). Here's a portion of the statement on how they will stand behind the article:

Bennett stated, "I have extended HardOCP.com’s pledge to correct any and all possible inconsistencies or errors in our editorial entitled 'Behind the Infinium Phantom Console' personally to Timothy Roberts and Kevin Bachus of Infinium Labs and they have yet to inform HardOCP.com of any information we presented as being not correct."

He has stated that they have given infinium multiple opportunities to state their case and correct any mistakes. Likey, infinium would rather state their case in a closed door meeting rather than putting their case into an email where the facts are clear. Without email *or tape* it's a he said she said situation.
