If it was installed without the user's knowledge, stole sensitive information like credit card numbers, and was created with obvious malicious intent, then yes, you'd probably end up in jail.
A eBook program being sloppy and careless in how it implements its DRM is not illegal chief. It's stupid, but it's not illegal.
