Seriously, stop and think about it for a second. We arrest people for planning to do things all the time. If we wait for them to actually do it we'd be screwed. It it true to a point though. You still have to have compelling evidence to prove that the plan is more than a plan and they're in the stages of enacting it. The only part of law in the US or Canada that allows otherwise is traffic law where no mens rea is required. |
