Eurogamer has a statement from CD Projekt to the report that they are sending letters to those accused of pirating The Witcher 2: Assassins of Kings. While restating their strong feelings about not using DRM, they clarify that this does not mean they are okay with their game being stolen:

However, that shouldn't be confused with us giving a green light to piracy. We will never approve of it, since it doesn't only affect us but has a negative impact on the whole game industry.

We've seen some of the concern online about our efforts to thwart piracy, and we can assure you that we only take legal actions against users who we are 100 per cent sure have downloaded our game illegally.

No, CD project, you cant be sure at all. You cant even be sure, that the IP is connected to the correct user as several cases over the last years showed. You think that the laywers and their IP research companies do make no errors? Do you think that they make sure, that the "right" users are blackmailed into paying high and unproportional sums? CD Project, you're teaming up with greedy bullies who exploit legal loopholes. Wise up!

Yes, you are a thief. Pirating the game when it was valued by CD Project at it's full retail price, and then purchasing it at a point in time when the game was on sale and you deemed the price acceptable, puts you squarely in pirate territory. This isn't pay what you want ala The Humble Indie Bundle. Not only that, but you started playing it initally with no money going to CD Project at for their development efforts. I really do not see how your mind can blur the difference between you being a pirate and not. You are a pirate.
