But in traditional RPGs you're following a linear path. You enter areas and you accomplish quests essentially in the order the designers intended.
In Oblivion you aren't. You do whatever you want whenever you want.

In Oblivion, the main story quests and the guild quests are performed in a linear order. You can't do the final quest unless you've done the quests before it. This is how it has worked in practically every RPG ever made. Fallout 1 was a rare exception, as there were only three main story quests, only two of which needed to be completed and could be completed in any order.

Scaling simply isn't necessary. Games like Fallout, Gothic, Arcanum, Baldur's Gate, etc, have proven this. Scaling exists because it's supposed to ensure that players never face an enemy they cannot defeat at their current level. Oblivion's poor implementation had the opposite effect, making enemies much harder than they should have been when you're at a high level. In either case, scaling is simply a lazy and easy way to avoid thoughtful design and balancing, much like regenerating health.
