| I love the fact that, in the end, Activision will be on the losing end of this whole mess. They may have the IP but they don't have the manpower that made it great. |

Isn't this a repeat of 2003?
2002: 2015inc release MoH: AA, under EA. 2003: 22 leave 2015inc [EA-ish] to form IW and release CoD, under Activision. 2009/10: 26 leave IW [Activision] to form Respawn and release ??? under EA.
Where ??? = some game with remarkable similarities to CoD/MoH
(yes 2015 is technically independent but IIRC a lot of the fuss at the time was because EA basically called the shots) |

| Wouldn't surprise me if they shutdown treyarch and moved everyone into IW. Assuming contracts force many future cod games to be made under the IW logo, this would be a solution to that problem. They could also force salaries down if they laid off treyarch then offered them new jobs at iw for peanuts. (plus let go some people to cut costs further) |

UPDATE: Respawn Entertainment is being funded initially with "several million" dollars in capital from EA, reports the LA Times. Additionally, the story claims that West and Zampella will own and have full control of the intellectual property that Respawn develops. There's no word on what they'll work on first, but West said he believes it will be on the scale of a "huge, summer blockbuster." Whatever they end up working on, West said they will consider taking it into other forms of media, including comic books and movies.
ORIGINAL STORY: A new development studio has been announced today, but this isn't just any new company -- it's being founded by Jason West and Vince Zampella, the former president and CEO, respectively, of Call of Duty developer Infinity Ward. This news comes amidst ongoing litigation between the two and Infinity Ward's owner, Activision.
The new company, Respawn Entertainment, will join the EA Partners program, giving Electronic Arts exclusive publishing and distribution rights for their future games.
"Respawn Entertainment marks a fresh start for Jason and me," said Vince Zampella, who will assume the role of General Manager at Respawn Entertainment. "For the past decade we led a great development team and poured our hearts into creating an epic game franchise. We're very proud of what we built -- and proud that so many millions of fans enjoyed those games. Today we hope to do it all over again -- open a new studio, hire a great team, and create brand new games with a new partner, EA."
"We're excited," added Jason West, President of Respawn Entertainment. "Now that the team is in control of the games and brands, we can ensure that the fans are treated as well as they deserve."
Respawn's official website, located at www.respawn.com, is currently comprised of nothing more than an email address, jobs@respawn.com, where Respawn will be accepting job resumes for designers, artists, and engineers. We have to wonder if Respawn already has two additional staffers, following the recent departure of lead designer Todd Alderman and lead software engineer Francesco Gigliotti from Infinity Ward.
Activision's lawsuit claims that the duo conspired with a rival publisher to form a new studio. West and Zampella's suit alleges "breach of contract, breach of the implied covenant of good faith and fair dealing, wrong termination in violation of public policy, and declaratory relief," as well as control over the Modern Warfare brand.

It doesn't mean Activision is being a shit about this, it can also mean that West and Zamp are simply offering these guys better contracts than their existing ones, which is probably the case, otherwise they all would have quit outright. I know I'd want more of stake in the profits if I was going to hop companies. |

So, at the current time can Activision release any COD games? Or can Respawn? It's a complicated situation.
Supposedly Activision owns the rights to the Call of Duty franchise as a whole. Infinity Ward claims they have the rights to the Modern Warfare name contractually, as in they were exclusively allowed to develop it as an IP within Activision. No one knows what happens to it now that they are gone as we don't know the contractual specifics nor how they will work out.
Treyarch is supposedly working on a Vietnam era CoD. There is another studio working on some strange 3rd person action/adventure Call of Duty game or something.
It's all pretty muddled right now, I doubt we'll know much of anything until the legal shit settles. I sincerely doubt that Respawn will get the Modern Warfare IP out of this though, they were owned by Activision. I figure they are pushing for a big settlement by using that contract clause as ammo. |

nin I doubt he gives much of a shit. Its the only true way of staying on top. One of his major cash cows just left. If he's not worried, he's fucking stupid.
Even if they get to keep the brand name, they can't release anything until this is all settled.
The PR show they've been putting on about bonuses says they've been paying attention, and you can bet shareholders are, also.

Yeah something definitely happened. Of all the things IW has done successfully over the years, what's the one denominator that stands out as the exception? Crooked publishers are nothing new, Activision is apparently the first to really suffer for it. I've been in, and seen, dev companies that have been screwed over by publishers. In the company I was in, the publisher cut all funding because we apparently weren't meeting certain milestones in time. Without funding, our company folded shop and ALL rights of the game (3/4th complete) went to the publisher to sell and reap all the profits.
World of business I suppose, but glad to see IW moving on and hopefully evolving out of this mess. To have that many people follow to the new company speaks volumes about the respect and trust they have for the IW founders, and to abandon such a wildly successful franchise as Call of Duty with only the belief they can do just as good or better with a new IP. |
