They are skirting the legal boundaries by "renting" the game to you. You can not get a copy of the ROM from them. You only have it temporarily and when you are done playing it is revoke. So they are claiming it is no different then renting a game from a retail store, as when you are done with playing the game you have to give the disc/cartridge back.
According to Wikipedia they have been doing this since 2001, and once in 2006 Nintendo told them to stop, and they did not, and nothing has come of it.
