It would be the ultimate "fuck you" to microsoft, but as others have said elsewhere, it would also be odd for publishers to have two different policies towards used gaming going on...

"Even digitally" doesn't mean that they won't sell it on the Xbone, it just means your 360 copy will not work or carry over.
I'm not trying to say they WILL do it, but there is nothing to stop people from doing it, and if Nintendo has shown us anything, it's that you can sell the same game multiple times for different systems.
