difference between youtube and megaupload is the amount of money they gave to politicians in the US. safe harbor status can be bought.

Missed our chance here in Central Illinois -- got nearly an inch of rain instead. It was a little weird to listen to a thunderstorm in late January.

it is sad we didnt get much snow this year. but on the upside the kids will get off school early this semester since they have not used snow days this winter.

the CIA is truly an oxymoron. these guys are now just realizing information travels faster in social networks than traditional news media. no wonder they always get fooled by people like chalabi who gets millions of dollars in exchange for false information.

I'm glad Sony came to their senses and dropped the touch screen button option. Touch screen buttons on phones/tablets suck. It's a very undesirable way to control a game. It's no surprise so many want to hook gamepads to their phone/tablet for games and why things like iCade exist (including their upcoming accessories).

i agree. touch screen controls take away viewable area and the strain on your finger tips caused by repeated tapping on a hard surface happens much sooner than with conventional buttons. i tried playing plants vs zombies on my nephews ipad and it hurt after a few minutes of playing in panic mode. also tried one of the driving games and the lag between turning the ipad and when the screen levels to the horizon gives me a headache. its like driving a car with bad suspension.

Crustacean Soup wrote on Jan 21, 2012, 03:53:
If there are links to places to illegally download games, that would be prohibited under SOPA, but I'm not positive whether the DMCA would cover it (can't recall, too lazy to reread the law at this hour). If it does, it needs a takedown notice for anything to happen.

The idea was that MU was informed about infringing material but did not take it down. If Youtube hasn't been informed of an infringement, there's no problem. That's what the whole DMCA safe harbor thing is about. Youtube is allowed to stay up, even if they might potentially have infringing material, so long as they don't know about it and remove it when they're asked.

DMCA took down popular sites that used to link to ROM files. so youtube links should be covered as well. and the idea that youtube is not aware of two year old videos that get over 50,000 views is laughable. the sites that people link to youtube how-to jailbreak/mod videos for consoles is the perfect starting point for anyone who want to find warez. one of the main problem with the megaupload case is that the DOJ claims they did not provide a useful search feature to find illegal content so that copyright holders can request their removal. youtube does the same by not tagging warez links on their site. its not like they are exempt from being web crawled by google. they own youtube. DMCA is simply not being enforced in a fair manner.

Well...

1) Jailbreaking was ruled to be legal. So I'm not sure why a video teaching you how to jailbreak would somehow violate anything, much less

2) actually be copyright infringement. Unless Apple somehow trademarked the entire act of jailbreaking.

I'm not sure what provision you want Youtube to be punished with? Under SOPA this would undoubtedly be illegal (as would reading an email with the word apple in it, most likely), but under the DMCA, there is no infringement in such a video. It's an instructional video and falls (justifiably) under the First Amendment.

Creston

well... maybe the videos are deemed legal but the links posted along with them that gives you all the tools and files needed to do the jailbreaking/modding is illegal. and after you jailbreak your device there are also videos showing off the result complete with download links for the games being played. dont tell me those are covered by the safe harbor status.

…they are willfully infringing copyrights themselves on these systems; have actual knowledge that the materials on their systems are infringing (or alternatively know facts or circumstances that would make infringing material apparent); receive a financial benefit directly attributable to copyright-infringing activity where the provider can control that activity; and have not removed, or disabled access to, known copyright infringing material from servers they control.

thats what took down megaupload. youtube has copyright infringing videos that teach consumers how to jailbreak iphones and consoles. complete with download links. and youtube serves ads that make them money. some videos have been around for at least a couple of years. yet youtube gets safe harbor status.

But this isn't true. For one, YouTube works hard to prevent this and works with companies to get their content down.

not true. jailbreak videos for PSP and iphone have been around for almost two years and youtube never saw it fit to remove. even if they dont brag about being pirates they sure take their time removing illegal content. all while making money by serving ads on the jailbreak videos.

Not even saying Megaupload didn't deserve it, they offered streaming with 0 hoops (no captchas, nothing) it was clear to anyone who knew that this wasn't gonna be going well for them.

then rapidshare should be worried. they never used captchas and have enabled unlimited download speed without any wait time even for free users.

That must be one hell of a treaty when you can request extradition of someone that has neither the nationality of the country he is in nor the country he is extradited to. To me, thats bona-fide kidnapping. Sanctioned by my own government.. that.. makes me pretty much speechless. Especially since exactly 0 people got hurt in this crime.

Its about time we put the sovereign back in nation

their mistake was to operate servers state side and to use paypal for their payment method. i wonder how long it would take for the feds to take down rapidshare. they used to have servers state side but have migrated almost everything to germany. their standardized use of secure download links is making it difficult to track illegal downloads because all the data are encrypted.

I think pretty much everyone can agree that Megauploads profits were almost exclusively at the expense of content creators.

youtube did the same thing and is still in the business of violating copyright laws. there seems to be a double standard for american companies versus overseas. i can still find pay per view fights and how to jailbreak videos for any electronic device complete with download links on youtube. yet the feds dont take down their business like megaupload.

So there ya have it - even if sopa doesn't pass, the feds can seize a domain any time they want, with no process whatsoever.

whats even worse is how the feds dealt with megaupload. youtube had a walk in the park in comparison. yet both sites served copyright material without consent. both profited. but youtube is seen as legit and was given safe harbor by the feds. something is fishy about this.

That you never want all your knowledge, ONLINE. Because right when you need it, some political activists just might black out wikipedia for a day, or week, or month.

seems to me you missed out on the concept of wikipedia and how it became popular with user submitted content that in the beginning were mostly plagiarized information. without due process SOPA and PIPA would have prevented wikipedia from getting their act together like it has today. so yeah complain about the politics and enjoy your free internet. the two are increasingly dependent on each other.

im glad blue participated on the blackout. wish more tech sites did the same thing. even ones not based in the US. i guess they think SOPA/PIPA wont affect them if they are based outside the states.

Wikipedia even did it fairly well, in that they only seemed to block the site for US users. At least, up here, I could access the site all day fine, so I'm assuming they must not have blocked it globally.

turning off javascript enabled US visitors to view wikipedia during the blackout. at least thats what i read on some news sites. i dont visit wikipedia on a regular basis so was not able to test it.
