Both quote the same person and words. Do you think there is a difference? Or do you believe the words are the same, therefore so is the intent and desired results?
Intent may be different but I won't be cock sure I know the intent because I don't know the contents of people's minds. I can only speculate and sometimes I don't want to do that.

I understand what you are saying. That context does matter. I guess in this situation I don't think the context matters, because other people have voiced similar concerns and claims and demands that Derek Smart made. I wonder if anyone has ever answered these tough questions. Anyway time will tell if Derek Smart was right. You can bet that he will remind everyone "I told you so" if his predictions turn out be right.

I assume you are in the US so this has already been passed via the court as a legal document. IANAL but the only way I can see where you might be able to claim some of your purchases fall under the old ToS would be if you had a second account that still fell under the old ToS. Even then you'd have to go into binding arbitration not a court (according to the ToS) in the state of California and argue that the ToS did not apply to that secondary account. The other side would argue that since you are already bound by the new ToS in one account, you are also bound via the other account because you already agreed to it.
My understanding is that some of the aspects of the TOS may be illegal and have not been challenged in court to find out.

Chooo Choo all aboard the walking back the features train. It's not over yet. They have over-promised, over hyped, over mislead gamer's and they will have to walk the claims back now or else risk facing angry backlash. Never trust preview videos. Learn the lessons of so many games before. What's in the trailers and previews is misleading.
Almost always, especially with big AAA games.

I remember when the Devs actually played game with the Founders, those people who paid good money early to let them start developing the game. They made promises like no 3rd person view and a bunch of other promises so that potential Founders would buy in. They seemed to genuinely listen to the feedback of the Founders. But after they got their money and they started selling mechs and gaining additional revenue, the Founders were largely ignored and the development priorities shifted away from what was promised. From the Founder's perspective and all the other early adopters this was a betrayal, the game was sold to them on a certain vision and that vision changed.

They made promises about a persistent universe they called Community Warfare. It's been 3 years and they just got a half assed Community Warfare that is tacked on? If some of you only knew the years of forum posts and drama that MWO has generated. Pretty early on, some people realized that this game was mostly a mech buying simulator and the gamepmlay and metagame was built around buying mechs and parts. That's the business model, sell more mechs. Who can forget the $500 US golden clan mechs...

Nevermind the technical issues like failed hit registration which they just cannot fix after all these years.

Sometimes Derek Smart says sensible things. Bottom line is that as long as players keep donating and paying for mostly future promises, Chris Roberts is going to be working on Star Citizen forever and promising and failing to deliver on those promises in an reasonable time.

Should have called it Early Access. We are seeing what normally happens during game development, not after the game is released. Also don't blame Iron Sky. When you contract out to someone, you accept their work when you release the result publicly. Rocksteady and WB didn't have to accept the shitty port of Iron Sky. Rocksteady and WB are ultimately responsible for quality control and they chose to release this pile of shit to the PC.

I chuckled when I read this "While we work on improving performance, we will also continue to make interim patches available to address issues for those still playing the game on PC."
"Still playing" you poor bastards. So many better games, so little time. Wait for the GOTY edition and get your steam refund if you still can. You can always buy it when it's GOTY. Don't support outrageous releases like this.

And this is why you should never ever preorder. Rocksteady is acting like they didn't know about the issues during their testing. Strange cause saying that it runs like shit on AMD cards would not do anything except hurt their preorders and their general sales. Wait a second...

Other Nvidia Gameworks title Witcher 3, Project Cars, and now Arkham Knight runs like shit on AMD cards. We are starting to develop a pattern but we need more data. What other Nvidia Gameworks title runs like shit on AMD cards on release? Those can't be the only examples.

Also the fanboys need to stop and think for a second. The world is going to be far worse off when there is only one player in the gaming graphics business. Competition is good for you. That doesn't mean you should buy cards against your best interest as a consumer. But AMD does keep Nvidia prices lower than they would be otherwise.
