He does specifically say that 'game art is a different issue, because it isn't software'. He's only concerned with the code, not the assets.

It's still not practical, of course. Developers make money from engine licenses, or market their games on the advantages they have from proprietary shaders, AI technology, physics modelling, or such. They're not about to give that away.
